    My advice - don't bother phoning, stick to the timescales and send the letters !!

    i have sent 2 letters requesting money... time scales ran out 2 weeks ago... just waiting to get paid now to file the claim with MCOL.

    after that, they have 28 days to action my case, that right?

    I'm not sure I could be bothered phoning them every day, btw, I rang 3 times and got a different story each time e.g.about when the alleged offer letter would be sent to me. For example, on the 1st call on Monday that I made, I was told the offer letter would reach me this week. On the 2nd call (thought I'd double check this) I was told the offer letter could take up to 56 days to be sent out! The right hand doesn't know what the left hand is doing at Natwest....

    I just thought I'd let you know that when I wrote to Natwest to claim my charges back they totally ignored my letters. I sent the 1st in February and the 2nd in March with no acknowledgment at all. I got an offer for the full amount today, I hadn't had a chance to fill out the court claim yet!

    Hi - hope you dont mind me asking you but can you point out the correct thread for wording of p of c. I have already filled one in for Nat West. Im doing another one now and having trouble fitting words into the 1080 characters. Sounds like you have filled your online form in - which wording did you use? Thanks for any help JG
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    Hiya - I used the following wording:-
    (NOT my work - I think Rex Mundi posted it originally, but I can't find the thread... I'll keep looking for it and edit my post later on.) It worked perfectly :)

    The Claimant has an account XXXXXXXX (put your account number)with the Defendant, opened DATE. Since DATE the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    It seems they have ignored my second letter too, I'm giving them until Friday and if I've heard nothing I'm sending the next one.
