    I would still send the letter, many people have had promises of offers that taken days or weeks to come through. The Letter Before Action should give 14 days as per the template.
  • strange one to report, well i feel its quite odd !!! filed with mcol on thursday paid via nasty west switch card money debited from my account , looked online at my statement transactions upto and including monday no mention of mcol payment!! + my balance has gone back up by £120 strangely enough what i paid for mcol for filing my claim against nasty west!!! customer services could offer no explanation as their system is down, strange event or just me paranoid? sorry just don't trust nasty west,

    I called natwest on Friday as my second letter deadline was up then. The woman stated there was an offer on my account but she couldnt tell me the amount. Decided after putting the phone down that this was not good enough, i mean if they called me and stated that they wanted to know how much i was going to pay off something i told them they would have to wait and see they wouldnt like it.

    So i called again and was told there was no offer on my account at all, it was still being dealt with Got the 8 weeks blurb, so i asked is this 8 weeks before i have the money in my account cause that would be in 4 weeks time and she stated no we have 8 weeks to make you an offer not 8 weeks to put money in your account!! Is this true?

    Also she told me she could tell when all letters were recevied and sent out so i asked about my second letter which i have signed for proof of and she said she couldnt tell me anything about it!

    Im getting more and more annoyed as days pass so am just going to go to my local court on wednesday and file a claim im not waiting 8 weeks for an offer for them to delay longer and not get my money until end of may june time!:mad:

    I am taking on nat west and have gone thorugh all procedures and templates The only response that I have had was my statements within the deadline All other letters have resulted in zilch repsonse. I wrote , for the last time in the week, giving them a final,final 48 hrs to make me offer (a response would be helpful) prior to my issuing proceedings on Monday. I am going ahead any way but I wonder is this a usual approach by Nat west

    It seems to vary a lot - some people have had quick responses and refunds of charges, and the other extreme where people like yourself get no response to any correspondance. I did ring to find out where my claim was up to (around a couple of weeks ago, I think) and was told an offer would be sent out to me. Not had anything in writing, so I'm going ahead with MCOL on Monday

    First of all, I was aware that my account had upgraded and believed at the time this would be useful so I have no complaints there, thanks anyway : )
    I have tried to find your link but I do not have another thread so I'm not sure where it is???

    PS What exactly IS a referral charge?

    How far back can you go to reclaim charges from Natwest? In the 1995 they took my £10000 overdraft and I signed something to say they could put it on my mortgage with Nationwide, so if I ever sell my house they are entitled to get there money back. Nearly all this money was from overdraft charges that multiplied in that time. Not trying to get the amount removed from my mortgage (although it would be nice) but if I could still claim I could get a vast amount of the £10000 paid back to me, if I can claim charges over 10 years old.

    If I remember correctly although I can't find the letter in early 2000's they sent me a letter saying they were doing this as they had something like 7 years to inform me they were doing this or they would have had to write the debt off iyswim.

    So although the debt is over 10 years old the charge to my mortgage account is less than 6 years old. If I can go after them what would be the best procedure to follow.

  • sorry bout that, the thread on here written by myself for ease of use by everyone claiming from natwest. The note normally will give an amount. If no amount is being forthcoming with any member of staff(all will have access) and note is normally after LBA sent in, then you follow through with what you have said and sue the bank. I pose this question, Would NatWest hold back from charging you? If yes then wait, if no what are you waiting for.
    The claim is yours and the decision is yours alone but no one loses if they follow the guidance here and win 100% of their claim not 80% not 90% but 100%.

    In relation to subject access request it is all data held by the bank on you, that includes notes on account the whole nine yards. It is not just statements, if you want them pay £5 for copy statements. Data and specifically on charges will go back to 1992. So if you are looking at claiming for charges from that date with the argument of concealment s32 Limitations Act, then data will exist
