    hi all, just filled out mcol claim form bet put my branch address as the defendant, is this correct? if not what address do you put in for natwest? and can you edit the form as necessary? thanks

  • Just an update for anyone else in the MCOL system (I thought it might be useful to give people an idea of what goes on as there is not much info on here once you get to the court stages).

    I started my online claim in January which Natwest acknowledged and stated their intention to defend. My claim was then passed to the county court on the 19th February. Since then I heard nothing so I decided to email them. After being passed backwards and forwards via email I decided to phone them and have been told that my claim is with a judge and they will either decide on a hearing or request further information. Sometime soon!

    You can claim for all the charges, it can't hurt to give your bank a quick call to ask then to refund them, it's worked for some but not others. You can always amend the total charges in your next letter explaining why.

    It can be very daunting, but don't worry, you are right, it's YOUR money & every penny counts! Good luck!

    Hi Rina

    It might be worth phoning them. I've had charges fully or partially refunded immediately in the past and ringing them to say I could not afford to pay them.

    Who did you email & phone? was it your bank? I thought banks had 28 days to file a defence ect ect then eventually you win by default....if you know what I mean?? Just didn't think it took that long :(

  • not sure - their defense is very wordy and very lenghty but they're asking me for further information and clarification relating to my claim.
  • this morning after waiting for 5 weeks and no reply i had a letter through the post explaing to me the charges will be paid in full back to me to my account. Im so chuffed. Keep at it, it really works.
    Has any one else had there charges back from natwest how long will it take for them to transfer money back to me.

    they have given 4 reasons of defence.
    1. this defence is filed and served without prejudice to the right of the
    defendant to apply for summary judgment in respect of and/or to strike
    out the particulars of claim.
    2. the defendant is embarrassed by the lack of particularity pleadedin the
    particulars of the claim to the extent that the particulars of claim fail
    to disclose reasonable grounds for bringing a claim against the
    defendant. in particular tha particulars of claim do not disclose any
    legally recognisable claim against the defendant.
    3. the defendant invites the claimant to remedy the above. in the
    event that the claimant fails to do so within 14 days of the service
    of the defence then the defendant will apply to the court for an
    oreder striking out the particulars of claim.
    4. the defendant reserves the right to plead to the paticulars of claim
    once and if the claimant properly particularises the same. in the
    meantime, it is denied that the claimant is entitled to the relief
    claimed or any relief wether as pleaded or at all.
