    Hope you don't mind me asking - what is "moneyclaim"? Unfortunately I don't have an answer to your question though!!

    Moneyclaim is the advised way to take the bank to court, it is just all done online instead of using your local court... x

    Thanks for the advice guys , this does mean i have won then ? i'm a bit worried i've jumped the gun a bit! how long should i went for a response then? how is this usually done,....

    Yes you have won. I would send a letter to them saying that judgment has been given and that you will give them 7 days to pay in full failing which you will take enforcement action.

    There is a small risk that they could apply to set aside the default judgment which they are more likely to do if you make it difficult for them. I was a lawyer in-house for 7 years. We would pay judgments straight away to avoid an effect on our Dunn & Bradstreet rating and so look like bad payers. However, if the bailiffs ever turned up, I would have immediately applied for a set aside.

    I get quite miffed by people trying to use the court system to "get back" at banks, etc. Yes, you can send the bailiffs in but unfortunately it is far less spectacular than people might think. What will happen is that they will be given a cheque and that your payment will be delayed.

    I tend to always go for the sensible and pragmatic approach to dealing with legal issues - but then as its my job, I don't like making work for myself!

    Hiya, just wondering if you could give me some advice.....

    -Sent letter 2 (asking for charges back with interest) on the 8th March 2007
    -E-Mailed the letters and summary to customer relations unit on the 11th March 2007 (just in case)...and was acknowledged to be received
    -Sent letter 3 (giving 14 days before court action) on the 25th March 2007 by recorded delivery
    -Even visited my branch and handed over documents on the 31st March 2007

    Given the odd call to customer relations unit who said that 'a letter is in the post' but havent received it - also now been given 2 different posting dates by Natwest for when the letters were sent to me.

    Its now the 12th April....what would you do? Had nothing in writing from Natwest at all....but just dont know if I should wait or start the MCOL route?

    If the MCOL route.....any step-by-step guides would be truely appreciated

  • I am hoping somebody can help me...

    I applied to Natwest for my bank charges back and after 3 weeks received the full amount £746 back WHICH WAS WONDERFUL!!!

    In the 2 months since then Nat West has taken out a further £344 in charges all related in one way or another to the original charges that were refunded.

    I resent a letter to them stating all times and amounts and that they all related to the charges that they have returned to me but they have refused to refund these charges and suggest that they close my account!!!!

    Has anybody else had these problems after receiving charges back or can anyone advise me if I have any claim on these new charges?

    If I had been stupid and built new charges off my own back then I would not care but they have 'accepted that the charges originally were unlawful' by refunding them - so surely any relating to them should be classed nul and void?

    PLEASE HELP

    Same here - I'm getting absolutely no where with them. I've had to report them to the IC!

    Gives me hope reading other peoples successes though :)

    Thanks for your help Tozer , i really don't have any issues with Natwest and they (apart from the charges) have always been good to me, so if i can help it i dont want to send the bailiffs in, i think i will wait till monday then send them a letter asking about the money...

    Its funny as in theory you could seek a winding up order of the bank. But that wouldn't help you either!

  • Hi there, I am joining the fight against Fatwest too!!

    I have sent them a letter notifying them of the charges I wish to be refunded and on the 14th day there is no reply. I trust I now do the Letter Before Action and on the 15th day can start court proceedings?

    My question is, they have kindly today sent me notice of charges of £28 due to a whole whacking 10p being overdrawn. Can I just add this to whatever I requested in my previous letter?
