    First thing is to open a second fall back account because it is possible they will close your account if you reclaim again.

    You will have to send a second letter saying you have 14 days before you file a claim for your second bunch of charges.

    If you're still around I have received a very similar defence from Natwest's solicitors. If I was to post some of the particulars of the defence would you have to time to offer me some advice relating to some of the more technical aspects? You're help in this would be greatly appreciated.

  • Thankyou, I have already sent a letter stating that they have 7 days to refund before legal action but they refuse to pay and I just wanted to know if a small claims court will grant a second refund?

    this is the courts I've been phoning - Natwest filed their defence early February - so unfortunately nothing else to do but sit and wait!!

    Sure - If I can. I should say that I am not a litigator - I am a commercial lawyer - but I know a little about the process.

    14 days for the letters mean 14 days not working days, however as you can see from the above post if the bank use 14 days they are likely to mean 14 working days.

  • just been on hold to customer relations for 10 mins, gave up and now trying again...

    on hold as we speak.. 3 mins so far...
  • I think i might of messed this bank charges thing up!!!!!

    On January 30th i sent my first letter claiming £1770
    I got a letter back from Mr Higley the week after to say they had my letter and were dealing with it.

    I called them a few times to see how things were going. Then i was told they were sending me an offer out. No offer arrived but a new batch of statements arrived and a letter explaining what could be claimed.

    This made me take a better look at the charges and i found they owed me £2254

    So i phoned them and they said to fax the amended list to them. So i did that and then nothing happened until i got on to someone who actually found the fax and logged it on the system.

    I keep phoning and they just say it's in the process of being validated and that the claim was only logged on the system on the 15th of March.
    and it can take up to 3 weeks.

    I really dont know what to do now as it's now nearly 15 weeks since i first put a claim in.

    I know i have messed up the time scales and now i would be at court stage and i really dont want to go down that path as it could set things back further.

    Do i just get on with it and wait or should i maybe try sending a different letter.

    Another thing is does anyone know what the difference between the phone numbers is

    0845 3030456 - Were the ones that got my claim on to the system and one woman was great and really helped. They sound like a smaller team.

    0800 0154212 - Were rude and lied about everything.

    But other people say they have more luck on the 0800 number

    I know there is not much anyone can help me on i guess i just needed to vent and write it all out.
