  • Hi, I have only joined today but have some great news! This subjuct was on Watchdog last night and the Financial Ombudsman Service gave a number for us to ring to help reclaim bank charges. It is 0845 080 1800. Give them a call, choose option 3 and explain you do not know how much you are owed, they will take some details from you and send a letter on your behalf to your bank, they have told me it could take up to 8 weeks. What have you got to lose apart from the price of a phone call.

    I have followed the whole process through to the Moneyclaim court letter and after receiving an acknowledgment from Nat West’s solicitors that they would defend all charges, within the 14 days, I then received an offer letter a week later from Nat West for £10,675.00! This is basically my full charges amount (I know!) minus the interest and court fees (about £1100). Should I take the money and run, or, as this is an offer should I wait until their time to file a court defense is up and then claim the original amount? I feel I'm almost there and would like to thank everyone whose threads I’ve read in the past for their help but am uncertain about this last action - regards, Roger

    As I understand it you can't refuse an offer of your full charges as the courts would frown on this but perhaps someone knows better? Had the offer been less than your full charges that is different.

    Hi,

    I thought that it was only frowned upon if the full amount had been offered before it got to the court stage. If you've already got to the court stage then you are entitled to hold out for the interest and court fees incurred.

    I don't know, this is still cloudy, maybe I misunderstood. But from what I understand "there is no right answer"

    I have just ignored an offer of the full amount minus interest and fees. When I posted the question I could not get a definative answer either way.

    Deadline for Natwest to respond to my initial letter was today. Not heard a thing. Until.... Letter popped through my letterbox this morning, big A4 one, took out the Personal Banking T&C's handbook, Customer Complaints leaflet and A Guide to Current Account Fees handbook, threw them away, then read with interest Mr Higley's letter.

    This bit made me laugh, may I quote

    "For these reasons [stated above], we do not agree with the basis of your complaint. We believe that the charges we levy are for providing services and that they ar not penalties or charges for default. Furthermore we believe that these charges are fair, reasonable and transparent"

    IF THAT'S THE CASE Mr Higley, why, in the next paragraph of your letter, do you say you have reviewed my case, and are prepared to offer me £4052.00?

    Inital claim was for £4052, with the interest added of £729.92 which totalled £4781.92

    Oh look, they have offered me full charges back, without interest. How odd!!:p

    I am accepting the offer, and i would like to take this opportunity to thank Martin, Edinburgh, Rex and everybody else who has offered their help and support in this matter.

    Finally, a word to others thinking about doing this or in the process of. DO IT, don't panic, worry or whatever, all the help you need in here in this site and forum, but make sure you stick it out and go for what you are owed. Remeber the shocking news earlier this week. The banks profits of billions. THAT'S YOUR MONEY!!! Get it back.

  • My offer from Natwest was credited to my account today. One thing I noticed about my large A4 letter was how much they actually looked into my circumstances, in my letter received on Saturday where they claim to be right and that I agreed with the terms and conditions when I took out the account, it then goes on to state that if I had arranged an overdraft on my account I could have avoided these charges all together, uh humm Mr bloody Higley, I have asked regularly, roughtly every six months for the last four years for an overdraft of just £50 to avoid unforseeable circumstances (ie CSA not paying my money into my account at all over christmas, totally out of my control) only to be told that no my credit score is just below their cut off (which is yet another annoying story).

    It then goes on to state that they are offering me this amount as full and final payment and that if I apply again in the future they will downgrade my account to a basic account - which is exaclty what I already have, thanks Mr Higley for looking personally and with great detail into my accounts history.
  • Hi just a very quick question before reclaiming bank charges.

    Has anyone had to actually go to court, as we will be trying to reclaim about £8000 of Natwest (various accounts) what worries me as it is a large amount they may actually take it all the way court.

  • hi could i just ask what i should do next with regards to my charges with natwest, i have sent the letter saying i would start the court process and got the following letter, its hard to know what to do, but i know you guys r very helpful so thanks...


    "further to your recent lettr regarding charges, i am writing to update you as to the status of your concern.
    due to the nature of the issue, and to ensure the best possible resolution of this matter, i feel that it will be beneficial for your concern to be taken forward by our customer relations unit-a specialist team dedcated to resolving more complex concerns"
    it goes on to say they will phone me within 10 days, not one letter i have sent them have they have not gone round the houses with me, is this a normal response, and should i give them 10 days or start the court process..
