Hi,
Have been waiting for a court date for 2 - 3 weeks and we have just received a copy of Natwests AQ.
Under G (other info) they have put.
Case management directions cannot be proposed until the claimant serves a reply to the request for further information which was due on 5 Feb 2007. In light of this, the Defendant may amend its defence or apply to strike out.
So close so far, has anyone else had this? Is there anything that I need to do? Was hoping to get some direction or atleast a date from the courts by now.
Has anyone else had this from Cobbetts?

sent natwest a letter claiming back my charges over 2 weeks ago on the 14th day i rcvd a letter asking me to call my local branch manager and stated i had nothing to worry about.
Called my Manager and he said it was just to invite me in to upgrade account (solo step account) explained to him that when i opened the account last december (05) was only entitled to this account as i have poor credit rating, he said that as i have ran my account well i need to come and speak to member of the team to upgrade.
Has anyone else had this
Are they gonna offer me this to stop me claiming???

I'd say its just a co-incidence to be honest. It will be a different department handling the reclaim whereas this is a local branch person.0

Hello, I have a relativly small claim of just over £100.. but as i am a student i need all the money i can get!
I sent the first letter and have since had the reply of "were thinking about it, wil get back to you never". It has been several weeks since then.
What do i do now? Simply follow the instructions and fire off the second letter or should i really wait?

Just a quick question...I filled out a changes to Particulars of claim at the court..I have a copy of the particulars, list of bank charges and a covering letter ready to send to Cobbetts...
should I wait until I hear back from the court that my changes have been approved, or should I just send them anyway to show Cobbetts that I mean business?

After letter 2 they have offered to pay the amount before interest as a gesture of good will £3283.40.

Yes, I ( .. and several others) have had this. It's misdirection from the NW ( .. if you're going through the Small Claims track), they're asking for more info. under CPR 18 Part.2 .. which doesn't apply if your claim is under £5000.
Now .. Cobbetts know that this doesn't apply ( .. under the Small Claims track), so I'd fire off a letter to your Judge ( .. and to Cobbetts too) and say something like:
May I please bring to the attention of the Judge that they have requested CPR 18 Part.2 from myself, however CPR 18 Part.2 does not apply to the small claims track. I have written to them to inform them of this, as I am sure they were already aware of this when they asked for that information from me. I can only conclude that the request was designed to intimidate.
Cobbetts do have all the necessary information pertaining to this case that they have asked for, as my initial enquiries led me to get that information from my local National Westminster Bank branch long before I decided to bring a Claim before the Court and I find it hard to believe that the National Westminster Bank would not have passed that information on to them.
I find it disheartening that they may apply to Strike Out based on:
#1: Information that they already have, and
#2: Information which they knew beforehand did not apply to this Claim.
