Hi, all.
Just to let you know that my case has been accepted and been served on the Na(s)t(y) West. They have 14 days to put up a defence.
I'm guessing that they will put up a defence, so I'll cross that bridge when I come to it.
As long as I can fill in the questionaire ( .. which I've heard is pretty bog-standard), I'll be okay.
Keep your fingers crossed for me.
Ken.Nat West = CONQUERED: 10/02/07 .. PAID UP IN FULL .. OVER £2800!! :j0 -
Hi
Can anyone tell me how I can send my £10, because of my problems with Natwest - they closed my acount and I could only get a cash account so I don't have a cheque book. Do you think a postal order will be ok as bank drafts are expensive.
Thanks and thanks inadvance for all the support with this its very reasuring to hear other peoples stories I wouldn't be doing this without all of you to help and guide me.

A postal order would be fine. Just make it out to Natwest or National Westminster Bank. How many surrealists does it take to change a lightbulb?

Strepsy wrote:Just received a letter this morning, in response to my first request for charges, and it says that they're sorry I was unhappy, blah blah, and that they're waiting for statements so they can look into the case. Also says she's enclosed a leaflet about how they deal with complaints but that was missing.
Got another letter today, just within the 14 day deadline, offering me £100. My charges were only £259... I think I'll have to send out the second request for charges. I'm worried that they'll offer me less nexttime though. Hubby is against going through court so this would be the last chance, don't want it to backfire.I've been lucky, I'll be lucky again. ~ Bette Davis0 -
Has anyone else been in this situation? If so, can you advise me on what to do next?
NatWest has defended my claim and I have received a letter from its Solicitor. They have also requested a lot of info in support of the claim. Lots of legal blurb which is all very confusing.
I'm concerned that I'm getting into something I really don't understand and can't even translate half of the legal jargon. Feel like withdrawing my claim as it's starting to stress me out and I can't be bothered with the hassle...
Has anyone else got this letter fron their bank? If so can you give me some advice?????
Thanks!0 -
Firstly, don't worry.
This is standard practice and is just intended to intimidate you.
There's plenty of advice around and a lot of people have been in the same situation.
Lastly, don't worry0 -

Have you got time/inclination to type up some of the legal jargon to see if we can explain it in simple terms? Might be able to set your mind at rest a bit.
I will have to nip offline shortly but will look back in during the afternoon to see if I can help.0 -
Thanks for your kind response: The legal Acts they are quoting here are those which I included in my original letters to the bank. These were taken from the Template letters off this website.
Here is some of the jargon in condensed form:
The letter is entitled:: "Request for further information and clarification"
"In relation to each charge please clarify the following:
a. is it the case of the Claimant the same should not have been charged,
b. If yes, please explain why the Claimant contends that the same should nit have been charged?
c. If no, is it the case of the Claimant that the same should not hav ebeen charged in this amount?
d. if yes, explain why the Claimant contends that the same should not have been charged in this amount and identify the sum the Claimaint contends should have been charged
e. If no, please state the Claimant's case
"In your claim you state that ""the banks charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law""
* Please specify the clause (s) pursuant to which the charges were applied
*Please specify whether the charges applied were due to a breach of contract by the Claimant
*Please identify in each case the particular breach of contract (by reference to appropriate term(s) of the contract) that the charge related to.
Paragraph 5: "In your claim you state that the charges are: ""invalid under the Unfair (Contrcats) terms Act 1977s.4 and Unfair Terms in Consumer Contracts Regulations 1999 Para 8 and Sch. (1) (e)"" and ""unresasonable within the meaning of the supply of goods and services act 1982 s 15""
*Please specify all of the facts relied on my the Claimant in support of the contentions in paragraph 5 (above) and in particular please identify the contractual provision (s) that the Claimant alleges are invalid by reference to UCTA/the Regulations.
Hope you can point me in the right direction. Thanks!0 -
Hi,
I have recieved a letter back from NatWest. It says the same old "we are sorry to hear you are not happy etc etc".
It also states that they will get back to me on the 8th of December, this is over the stated time I gave them.
Should I send my second letter to them now or wait until the 8th?
Thanks in advance
