If anyone else has had this letter, let me know what you did next. I'm almost on my way to the County Court...
Cheers!
HERE is an example of how I list out the charges using Word when writing to the bank. I've used this with different banks, and never had any complaints about the layout. Just total up the years at the end to give the total of the claim. How many surrealists does it take to change a lightbulb?

Hi,
Was really hoping someone may be able to answer my questions
Ive read loads of the threads, but cant seem to find a direct answer to this (sorry if its already been posted). THe bank is HSBC.
A) Are you able to claim back Interest charged on 1) going into your overdraft or 2) going over your overdraft
Eg. If I have a 1500 overdraft limit, and then say used 1800, then I have been charged £16 interest (doesnt appear to be a fixed rate fee as such). Am I able to claim this back ?I have been charged lots of times £1.50 etc for taking cash out the bank (I think this was when I lived abroad). This can be say £30 a month. Im assuming I cant claim this back?
Really hope someone can help
Thanks:money:0 -
I have sent the 1st letter to HSBC back in early December and I received my bank statements.
I sent the 2nd letter on 01/01/07 demanding my £1452 back but this letter was completely ignored and I have heard nothing back.
I then wrote a 3rd letter stating they have 7 days to reply on 19/01/01 and delivered it to my banks letter box in person.
I have still yet to have a response to my 2nd or 3rd letters... It has been over the 7 days I gave them should I proceed with the court action or wait a little longer??
It seems other people heard back from HSBC pretty quickly but I havn`t!0 -

Generally no, these are not penalty charges.I have been charged lots of times £1.50 etc for taking cash out the bank (I think this was when I lived abroad). This can be say £30 a month. Im assuming I cant claim this back?

You can't claim interest back for either overdraft or in excess of overdraft, only for the punitive charges for using excess overdraft. Furthermore you can only claim the statutory interest on those excess charges at the court claim stage. Nor can you claim back fees for using ATM's overseas. Hope that helps.0 -
Thanks for answering my questions..
Seems strange that I wasnt charged this one-off fee, when most others seem to have been.
Good luck everyone trying to get their money back0 -

Cheers Rex, hopefully it's not five months, I was hoping to be out of here in June! Will keep you posted.0 -
Just a quick update.
Have rec'd an offer of £1629 form HSBC. I was asking for £1972 so am happy to accept their offer.HSBC have stated that the funds will be in my account within 7 days. Now for the stupid questions
1 Should I advise Moneyclaim now that I have accepted an offer and cancel proceedings(Will payment be delayed byHSBC as proceedings are still ongoing) ?
2 No chance of getting a refund on my £120 court fees ?
Sounds stupid I know, but if you don't ask etc.....
Many thanks for all help received.0 -

Try phoning the bank. Tell them you will stop the court case only after you receive the money. You can try to add in the court fees at the same time (may or may not work). Once you receive the money, you MUST inform the court you are dropping the case. How many surrealists does it take to change a lightbulb?

I got the standard "thank you for your letter, we're sorry you feel the need to complain, we'll be in touch within 4 weeks with the result of the investigation" reply in the post this morning.
I'm assuming that I allow them the 4 weeks yes?0
