    I've been claiming £2300 from HSBC. Got a partial off today for £1400, with the usual guff about you will fail in court and we are offering this sum without accepting liability etc.

    Now should I accept or push for the full ammont. It's not the cash, it's the principle, me being a long term customer of 15 years and constantly putting up with little mistakes made by them. Like the time 3 days before Xmas and my card was swallowed by a machine because it turned out they had emptied my account and transferred the money elsewhere and couldn't sort it until after Xmas holidays. You know little inconvieniencies like that.

    And them being money grabbing toerags!

    What do people think? Go for more or settle for the ammount, or is it worth giving them a call and saying I'll settle for a sum nearer the original figure?

    Thanks for any input, I've got ten days to reply.

    did your claim include interest? Im in a similar situation to you but having called them earlier today didnt get anywhere trying to negotiate a figure closing to the asking price?!

    Capital One £1112 Request letter sent, 11/06/07 offer of 348 received, "ill have a part payment pls along with the rest" leter sent
    Black Horse £25 supposedly?! - i think not! show me evidence!
    Halifax lBA sent 20/06, Rejection letter 22/06, Phoned for Reevaluation 25/06 ..the waiting starts

    yes the claim did include interest. The figure was £2343.62 in total. The offer was £1404.35

    I had an offer from DG of £776 for my claim which I refused and stated that with my costs, my claim now totalled over £1K as I had petrol, admin costs and court attendance costs (I was at the Mercantile Court, Leeds on 28 June [8 hours] and got a 28 day stay).
    They've come back to me stating:
    "As you should be aware, costs are not recoverable in the Small Claims Track. The Civil Procedural Rules part 45 allow for fixed costs of issuing, which in this instance, amount to £80. For the avoidance of doubt, your claim for costs is noted and denied. The CPR sets out strict guidelines in relation to costs in the small claims track which we feel that both parties should strictly adhere to. If you do not concur, we look forward to receiving the legal authority in relation to this portion of your claim.
    A reasonable offer in a without prejucide basis has been made based upon your claim potential and we consider that our client's offer has been unreasonably rejected. In the event that your claim was to proceed to a hearing, we seek to reserve the right on the part of our client to refer to our previous offer of settlement when the question of costs arises. Our intention in this respect is to bring the court's attention to the fact that a reasonable offer has been made and rejected by you and to make submissions to the Judge on this aspect.
    Our client therefore remains willing, for the reasons set out in our letter dated 29 June to meet your principal claim, less the statute barred claim, on a without prejudice basis."
    I don't know if they're bull*****ing me or not. confused.gif Does anybody know if it's worth continuing or I'd be better cutting my losses and running?

  • Having written to HSBC to reclaim my charges, plus interest, amounting to 673.66, and asking for a full response within 14 days, this is the reply they sent me on July 6th.

    "I am looking into the matters you have raised and will contact you with a full response as soon as i have completed my investigations."

    They have also sent me a leaflet entitled 'Listening to your Comments'.

    Are they merely stalling?
    Should i progrees to the next template letter threatening legal action?
    What is the best course of action for me to now take?

    Advice would be welcome.

    Have a read back through this forum and you will see that we have all been in your position, hsbc normally reply on or around eight weeks from your letter requesting money back, with an offer.

    It really is up to you if you stick to your time scale of two weeks before your proceed with next letter threatening court action or you can wait the eight weeks . From what has been written on here you will see that its normally quicker to wait their eight weeks and see what offer they make you, baring in mind that you won t be offered the interest unless you go to court and not guaranteed to get whole amount, but generally they offer between 80% -100%.

    The decision is really for you to make.

    I have just received my offer of £1,857.25 was asking just under the £2,000 just waiting for money to go into my account now. (i waited the eight weeks and they gave me offer on the 7th week)

    Good luck with whatever route you take

    hmm mine was 2518 with interest, 2221 without and my offers came in at 1887! Really dont have a clue how they are calculating these things now.. obviously its not a standard 85% thing!!!!

    I would take it :j ok the interest is quite a bit money and i bet your thinking what you could do with that alone without the charges as well but at the end of the day you could have that money in your account in next two weeks (one if your lucky) if you go down the court route it could be months and quite stressfull from what people have said on here.

    The decision is really yours but i would after alot of thought just accept it and run:rotfl: Its money that you thought you would never see again.

    I can fully appreciate your feelings though on this.
