  • Well, no news is good news, but all I have to report so far is an 'out of office auto reply' saying my email has been received and will be dealt with as soon as possible........

    I'd like to say I have more faith in the courts than I do in the banks....I'd like to.......but being the conspiracy theorist that I am, I have to wonder just who governs who......

    So only time will tell if this is a 'par for the course' response, or whether the courts do indeed have any substance?

    Just thought I'd share with you my latest reply from the HSBC emessage service, after probably 40 messages backwards and forwards keeping them posted with my various attempts at making them budge and generally nagging them for an update/offer.

    This morning's semi-automatic response said:

    "...in this instance I have forwarded your comments to the relevant department asking them to give your case utmost priority.."

    and if that isn't laughable in itself....

    "...I'd also like to apologise again for the continued delay and thank you for your incessant patience..."

    Good to know that at least the 'little people' in their organision seem to have a sense of humour too ;-) I've become all too consumed in this claim, so that little gesture broke at least a little of the dead-lock for me with a smile.

    Time to take a day or two off from worrying about money I may never see, which I never thought I'd get back anyway, and sit back and relax a bit, just watching and waiting to see what the bank and courts next move will be.

    It's an education in itself :-)

    I tried to email via online banking to find out the contents of the letter making its slow way to me. They replied saying that it was not yet scanned into their system so they can't tell me.<O:p</O:p

    I phoned them up this morning and after a few mins on hold I was told that I had been made an offer and an amount was quoted. The chap said to sign the letter, when it arrives, and send it back. Then he said he would just confirm with the quality assurance department that what he had quoted was accurate. After a long wait on hold he said that he didn't know if the figure he gave me was right or not!!!! I asked him where he had got it from and he said that he had it on his screen but didn't know what it was exactly. So weird!

    <O:p</O:pSo I was really happy briefly but now I have no idea what will happen as the guy seemed really confused - how could he quote me an amount and then say actually no I am not sure if that’s what we are offering or if you are being made an offer?!!

    I know I should be patient but I have recently been made redundant an the amount he said I might be offered would be significant to me at this point. Trouble is after months of silly games I have no faith in them what so ever. I don't even trust them when they say they have sent a letter.

    I have been been trying to reclaim my charges since 7th February (the date of my first letter) Heres my story so far:

    Went into my branch of HSBC and requested my bank statements for the past 6 years (they infact hadnt kept them for a complete 6 years was a few weeks missing) Paid £10 cash to the manager and left with a huge pile of paper.

    Wrote my first letter to HSBC on the 7th February requesting my charges be repayed to me.

    Recieved a letter on the 15th February saying they are looking into it and they have enclosed a leaflet (which they hadnt) about how the matters are dealt with.

    Then recieved another letter from them dated 8th March saying the bank does not agree the charges are unfair. This letter also was automated and had errors in it. They had left the PROMPT for them to enclose another leaflet in the letter. And again no leaflet enclosed???

    By then i had already filed court procedings with Money Claim Online on the 21st february (14 days after 1st letter) to which HSBC had until 12th March to file a defence. Or i win by Default.

    They filed a defence on the 11th of March.

    I was then transferred to my local county court at Colchester and recieved an allocation questionaire on the 22nd of March. I completed and returned to the court.

    12th April i recieved a letter from the court saying that HSBC had until 4pm 19th April to return their copy of the Allocation Questionaire or there defence will be struck out and i win by default.

    The court recieved their AQ on the 18th April with them requesting a month extension to negiotiate a settlement. Which on the 19th April was granted to them by the Judge (for some reason he stayed action for 2 months??)

    So we (me and HSBC/DG Solicitors) had until 19th June to try and settle the matter or Narrow the issues. I have contacted them with all my details, outlining all charges to them again and requesting all available dates they are able to discuss this matter either in person or otherwise as instructed to do so by Colchester County Court. Also left numerous messages in the voicemails to which i have also had no response.

    I have Recieved nothing from DG or HSBC since 17th of April (nothing since it was transferred to my local County Court)

    We both now have until 4pm 3rd July to file at court an agreed report of the outcomes of negotiations including steps taking by both parties towards a settlement.

    SO all in all its going to take 5 months to be awarded my money back and then i will prob have to get the ballifs in for them to pay up.

    Original claim £722.50 (no interest)
    Claim dated 15th May £1330.11 (Interest and MCO included)

    So to all those complaining its taken my "friends" 3 weeks and mines aready 5 weeks think of the people like me that have been going through this for 5 months !

    If anyone has any info about what happens when you go to court and any ideas of what i can write in my report to the court please.

    Thanks for letting me rant on hope this timescale might help others.

    I don t think the staff even no anymore whats going on!! The amount on screen must of been the amount, but from what i have read on here lately they Say that some people have asked and the staff say they don t have that information then on some they tell them.

    Its a mystery thats getting on everyones !!!!

    I would keep perstering them daily.

    Just been reading back on some of the success stories and some had payouts within weeks some had to wait months, like essexboy message above. There seems to be no ryhme or reason with them.

    I understand that you must desperately need money now under the circumstances maybe you could offer to work at their office to help clear the backlog of claims, starting with your own(lol) maybe you can then give us all hints as to why some are dealt with before the others.

    I ve been waiting approx 4mths, mainly due to statements never coming, sure that must be another stalling tactics.

    Anyway thats my thoughts on the subject today, this site is taking over my life. lol

    I am just in the process of starting my claim, but I have a couple of questions, if anyone out there is kind enough to help.

    - I have got the last 6 years of statements from the HSBC website and put them in a spreadsheet. However, there is no description on the charges, it just says 'Charges' or 'Total Charges'. I am concerned that if I submit this to them they will say that there is not enough information and return the claim - a delaying tactic. Are these descriptions enough?

    - I have 2 accounts with charges that I wish to claim; 1 with around £3200 (plus interested) and another with £800 (plus interest). Can I do both of these in the same claim, or do they need to be separate?

    - Finally - an odd thing happened to me yesterday. I have gone onto the HSBC website to get my charge details a few times over the last few days. At around lunchtime yesterday I got a call from HSBC - basically about nothing. Ostensibly they were asking if i wanted to change my credit card into a loan, but I said that I was sorting out my finances right now and didn't want to make any decisions. The person from HSBC then asked me 'can you tell me what financial decisions you are trying to make'?? Then when I fobbed her off, she said 'Is there anything I can help you with at the moment? Anything at all?'

    Basically, I think that HSBC are watching who accesses their old statements, and then calling them to find out what they are up to. Call me paranoid, but....

    I think all Banks seem to be in state of confusion, why do they pay out some but not others??!! Even claims for small amounts are rejected, when they pay out bigger ones.
    Lou - have you heard anything yet? When is your 8 weeks up?

    If you click on the word 'charges' on your online statements it should bring up a pop up which will give you a brief description of it, ie recall charge or card misuse. 'Total Charges' just come up as that, as far as they are aware these are for going over your overdraft limit. Most of my charges were 'total charges' but for those that weren't I put down the description that they used online. I've since spoken to them and asked them specifically if the format of my claim was ok and they said yes (mind you that doesnt mean much as they seem to be changing their minds all over the place lately!)

    I'm also claiming on 2 different accounts but i have put them on separate claims. I didnt want to give them any reason to mess things up and i thought things could get a little confusing if they had too many numbers to deal with at one time! :rotfl:

    Lets see what happens next.

  • Have taken HSBC to small claims, they are defending action but have sent me an offer for £2111 (£500 less than the amount including court fees) Have to reject offer by letter does not appear to be phone number available. They state it may take 8 wks if I reject offer. Am concerned that a court may have set a precedent by then. Any advice??? Would be happy with £2400:rolleyes:
