D+G solicitors never once contacted me eeven though i called them twice leaving my details and asking for a call back.:mad:
The last day for them to file a defence has now gone and i have sent my "judgement by default " paperwork to the court and still i have not heard from them
So in my belief u are not alone in not being contacted.

hi, hope someone can help me with a couple of things
1.im claiming against hsbc and and have started court proceedings. i am currently a single parent and full time student so am not working at the moment. i was aware that it was probably better to claim on mcol so paid the £50 even though i knew i would probably be exempt. but now hsbc are defendind my claim and im worried about court costs as i couldnt possible afford these. can i apply to be exempt from paying these???
2. also as i said im claiming against hsbc and have always used the templates and stuck to martins rule that we set the deadlines not the banks. i did have a letter from hsbc a while ago saying they are investigating and the usual 8 week wait, but i went ahead with next letter.i finally started court proceedings and i received a letter from them stating that they have been made aware of my claim and all further correspondence will be through their solicitors. since then ive been reading posts from people saying they waited the 8 weeks and received their money back. i know feel as i have maybe shot myself in the foot!!!!!!! anyones views on this would be greatly appreciated0 -
Too late now to be worrying about shooting yourself in the foot, you've filed your claim so you need to look ahead now to what will happen next. Any further court fees are only in your claim is more than £1500 so don't worry about that.
You'll find links to how to reply to the solicitors should they ask for further details these are linked in the Reclaim Help Thread. If you do get such a letter send off the list of charges along with the long version of the POC, once again in the Reclaim Help Thread. You can also at that time say you will happily settle out of court for the full amount + court costs but no interest if this will jog them along. Or indeed phone the bank and say that and see what happens.0 -

I just phoned the court to ask for a timetable of when my "judgement by default " might be heard and i was informed that HSBC had defended the claim on the 24 th may so my default will not be heard
I was told by the court that before weds 30th that no defence had been entered so i am now seriously P&^%$ed off
I am thinking of phoning the solicitors and seeing if we can cut a deal that is how fed up i am

its infuriating isnt it? The courts seem to allow the banks so much leeway with timing yet we have to do things to the timescales given.

Hi, I'm not sure what to do now....
I successfully claimed once from HSBC then they kept charging me so I started a new claim.
When I filled in the spread sheet I put £1509.00 in the 'estimate of previous charges' box because this was my charges from the first claim.
My totals were £175 in charges and £105.50 in interest in penalties.
When I filled it in it seemed like a lot of interest for a small amount of charges - I guessed it was cos it takes into account the fact that the 'cumulative penalties charged' were now £1684.00.
Total claim with court fees (of £30) is £310.50.
I'm at the stage where I'm waiting for a court date. HSBC made me an offer for £205 but I turned that down & sent them a standard letter.
I had a letter this morning offering me £211.77 and saying that they will state in court that the amount of interest i'm claiming is not their responsibility, I turned down a reasonable offer, and they'll seek an order that I pay their court costs.
What do I do? I'm worried I didn't fill the spreadsheet in right?
I know it's only £100 but that's make loads of difference at the minute, I'm scared that if I don't take the £211.77 I'll end up with nothing.
Please does anyone have any advice?0 -

You should not be claiming the interest based on previous charges. The only interest you would be entitled to, if awarded, is on the current charges. I can only suggest you look at what deducting the difference in interest leaves you with and whether their offer now seems reasonable enough to accept prior to court. If it doesnt and you still intend to go to court then you will need to amend your claim to reflect the drop in interest due to your error.
Interest is only awarded by the judge on judgement in your favour at court. You arent entitled to it prior although you can ask for it and some banks do pay it. If after recalculating the interest you are left with an offer amount that covers your current charges and court costs then you must accept it. Good luck0
