    Afternoon All

    I'm quite a way down the reclain process with HSBC now. They submitted a defence before the 28 day deadline and this morning I received another letter from my local court.

    'WITHOUT A HEARING OF THE COURTS OWN INITITATIVE'

    ''1. The court of its own motion is considering striking out the defence as an abuse of process on the basis that the defendant has settled all previous claims of this nature.
    2. If the defendant objects to this course of action, it is to file at court by 4pm on 17th June 2007 a schedule setting out a list of all the claims it has pursued to trial and all the claims it has settled.''

    Am I right in thinking that this means that the court is pushing HSBC to settle without a hearing? The filing at court date is a Sunay, is this odd?

    Has anyone received a similar letter?

    It means the judge is probably fed up with banks not turning up in court. Good news for you, as it means they will have no defence and you should get judgement.
  • My partner recently sent the 2nd letter to HSBC asking for the repayment of charges plus interest and he has now received an acknowledgment from them saying that they are "looking into it". The 14 days for a full response have now elapsed and he is unsure as to how to proceed.

    What should he do now? Any advice with his would be greatly appreciated.

    I just spoke to HSBC head office, they told me that I will receive an offer letter on or by the 26th June but they are really struggling to keep up.

    As soon as I get my money I am filing a second claim for the HUNDREDS they have charged me since I started this claim!!!

    I have sent a letter off to HSBC asking for my bank charges back and stating how much they totalled.

    They wrote me a letter back within the 14 days basically stating that someone was looking into this and that I would here something back soon.

    Do I wait for a response or do I carry on regardless go to the next stage of threatening court action?

    its up to you a lot of people have been waiting and then gettin their offers in 8 weeks if u read the thread. i didnt actually get a letter from them stating that so after i had sent the 2 letter and had no rply i filed for court they have till 30th to put up a defence.but hopefully they will pay up sooner

    i have taken HSBC to court and the cut off date is 2nd june i was reading some of the success stories which said that after taking the bank to court they heard from the bank quite quickly.
    im starting to panic that maybe my bank are going to fight my case and i may have to defend myself in court.
    i would feel intimidated if i ahd to explain why i should have the money back.
    has anybody else had to go to court to defend their case???

    id be grateful for any replies

    i an in the same boat they have till 30th may so only 8 days left an i havent heard anything from their solicitors an no money been put into my account. dont panic yet tho there's still hope
