You're definitely right to stick to YOUR original schedule.
I've been through the whole thing, sent the 2 letters, got fobbed off, filed MCOL on Easter Monday, got letter today to say HSBC are defending the claim (about £4600 altogether)!

I thought I was worried before but now really scared! Has anybody actually got to the "going to court" bit?

    Isabelle,

Have a look back a couple of pages to my post that I put in - 48 hours ago, I was bricking myself, wondering whether I had done the right thing. This morning I got an offer letter, for more than I claimed.

If you have the time to spare, have a look back at all these posts and the ones on the Success Stories thread - you will see that some people did end up going to court, but the banks never showed, so they got judgement.

    Keep the faith!

    xXx

I am surprised,as when HSBC put in their defence, MCOL told me that the allocation questionnaires, had been scrapped a few weeks ago.

Things have now been transferred to my local court, and I was sent an allocation questionnaire, today.

It looks like there is no consistencey.
  • I just got a reply to my 14 day letter from HSBC for a request for £1256, they say I have to provide an itemised letter with date and description of each charge, "in order to consider your request". Did I miss something? was I meant to do this in the original letter? They're obviously stalling but wondering if I just write out all the details they request or should I write something more aggressive?

    Hi there

Yes, you should have sent a list of all the charges and date incurred with your first letter (as described in step 1). You can do this on a spreadsheet or use the interest calculator on the website.
If they don't respond to your first letter itemising and requesting re-imbursement of the charges, you can then go onto letter number 2 threatening to take them to court (again, look at the thread on MSE website).
    Hope this helps.

Not being funny but that made no sense at all. What is the problem?
  • I have made a claim for refund of charges against HSBC and have got to stage of taking them to Court. I have a letter from the court saying the bank intends to defend the case. Is this normal procedure?

Hi, this question could of been asked before but wonder if anyone can help..

HSBC had until April 22nd to defend of acknowledge. They Acknowledged on April 12th so now have the 28 days from service... so what date does that give them until? The Claim was serviced from April 8th...

Just a bit confused as to what date I can file judgement... is it 28 days from the 8th Of April? so making it 6th Of May to file judgement

    Thanks in advance

    Laura

Just bumping this up.... any help would be grateful even though it is a bit of a dumb question:confused:
Thanks to everyone that posts :T:money:

If your claim was deemed to be served on the 8th April then it will be 28 calendar days. As long as your bank don't enter a defence then you can file Judgement by default on the 7th May as the 6th is a Sunday!

    Taff ;)
