Very surprised that they are even having an allocation hearing. Are you within the small claims jurisdiction (less than £5k)?
The AQs are only being dispensed with in the courts whose judges are fed up with the banks just wasting their time. There are still many that are having to go through the tedious extra time. Hopefully they'll all be done with them soon, it knocks a few weeks off the overall timescale...Lou0 -

I wrote to HSBC back in February this year in relation to recovering my Bank Charges
All ive had in 7 weeks is a standard letter 2 weeks ago saying there investigating the claim
I spoke to the Financial Ombudsman today who will contact the Bank for me. Is it best to go through this route or actually take the Bank to Court instead
Please can anyone advise me on the best options0 -
Hi - Claiming about £21,000 from HSBC. The've offered about 50% of this, within a few days, should I accept or battle on. Any comments would be appreciated. Many thanks
Hello - having been a big claimer in the past few weeks I would certainly hold out for more. With my business claim i agreed to meet them in the middle if they paid within 2 days as I needed the money for the VAT man! Remember if you afford to go the whole way (and with HSBC it invariably means a few months) you should get everything. My advice would be to have a figure in mind that you're happy to accept and negotiate. They've already admitted being in the wrong by making you an offer...Lou0 -
I have been through the MCOL and HSBC have defended - The day before I was able to enter judgement against them - GUTTED!!
Can somebody please let me know the 'what happens next' - Is this likely to go to court now - Or are HSBC likely to offer a settlement before it gets there?
If it does go to court will I have to say anything etc?

HSBC have a new step in the dance. :dance: They send you a letter asking for the list of charges including descriptions of the charges just before you are due to take them to court. (even though you sent one with your first and second request!)
So, here's teh quickest way to do this: Copy and paste the Charges and Interest calculator into a word document. There is a spare column on the left which is very useful - copy and past the word CHARGE on every row (highlight the column and paste) then change it if its described as something else (eg TOTAL CHARGES).
Either send this with your first request and keep a copy as they will ask for it again or send it when they ask, but just carry on with your own timetable and file with MCOL anyway. Its a delay tactic, but I think its wise to comply incase they put in their defence that you wouldn't prove your charges.

Ok another newbie question I am afraid... I have calculated my charges with interest.... and am about to politely request over £4000 with my first letter, do I send it to my branch or somewhere else?
Oh and another newbie question sorry!...... I am claiming a total for two accounts, my sole account and my joint account (with the wife). Do I put in two letters or add them all together in one, also do you think I should put both ours names on the letter?0 -
Hi everyone i filled out my court form and sent the money they asked for but they sent it back so i called them and they said i shouldnt have paid anyway
also my reference number had changed and i should of been informed (i hadnt ) i then called HBBC solicitors left a nice message asking what was going on and as i was at work when they replied they left a mesage saying sorry for delay they will get back back to me asap i had re sent all correspondence they asked for so does anyone know what happens now i started this in DECEMBER !!!! :mad:

Personally I would follow through with the claim myself. All the resources you need are available. Some people have had some success using the FO, but I don't know how busy they are.0 -

Picture the scene.... husband and I get up this morning, I go off to put the kettle on, he goes off to get the post. I come out of the kitchen to find him with a face like thunder, muttering oaths about the bank, and how he has had enough of them and now I can take over the handling of them (I have been doing all the letters all along, but he appeared to be in such a strop that I did not remind him of that fact!) and hands a letter over to me. It's from HSBC. I scan it, expecting to find the words "we're closing your account" and instead it's an OFFER for £2,565.45!!!!! YAYYYY!!! Husband had been winding me up, and he had a huge grin on his face!
If you look back on the threads I have posted recently, you will see that I was getting really worried, having been through the letter to the bank, MCOL, the bank filing their defence at the 11th hour, and a letter from their solicitors asking for further substantiation of our claim, and how I wished I had just left them to get on with it and waited the 6-8 weeks....
The letter from HSBC today refers to my letter dated 20 February 2007, i.e. the very first letter I sent. It makes no mention of the County Court or solicitors - so what the hell is going on??
Nay mind - I will be getting the acceptance form off to them today or Monday, and then probably just wait for the letter which THEN tells us the account is being closed...!
In the meantime, I am going to enjoy my weekend :T
So, hang in there everyone - it really can be worth it!
p.s. My original claim was actually for £2,425.50 - so I have made some money!!
