    The bank is telling me I am only entitled to 6 years statements is this correct? Also they are telling me that the 40 day law is 40 working days not calendar days, this is HSBC

    I finally got thro to them on the phone today, on the phone, he told me a letter was sent to me yesterday, now any peeps with expierence, in your opinions and looking at the dates i sent the letters off, is this letter likely to be an offer, a refusal or justa standard we are still looking into it?

    Hello Everybody,

    My timescale:

    I sent letter requesting statements 29 Jan

    Sent first letter for refund 22 Feb

    Sent LBA to PO Box in Leeds 19 March.

    As my post, i have today received the letter from the bank, and it reads as such.

    Dear Mr So and So,


    Thank you for your letter dated 19 March 2007 requestions a refund of your bank charges of £1418.50 passed during the last 6 years.

    The bank does not agree that our charges are in any way unfair or unenforceable. The contract between the bank and its customers is governed bu our Personal Banking Terns and Conditions. If you ask us to make a payment that would, if met by us, lead to your account going overdrawn, or over an agreed overdraft limit, the bank considers whether or not to make this payment and a fee is payable for this service.

    Our fees and charges are stated in out published price list and the circumstances in which these charges will apply are set out in out terms and conditions.

    While i accept that this letter will not provide the response that you hoped for, i trust that i have been able to clarify the banks position. However, should this not be the case, i enclose a copy of out leaflet which explains how these matters are dealt with and the attached guidance sheet explains the next steps to you.

    Now the only thing enclosed with this letter was a guidance sheet which reads as such

    We Hope that you will be happy with the attached response and that this matter has now been addressed to your situation.

    Alternatively, if you wish to escalate your concerns to the next stage, you can write to the senious manager of our service quality team, at the the following address, enclosing a copy of this letter:

    IF we do not hear from you within the next eight weeks, we will consifer matters resolved.

    Cases we cannot resolve can ultimately be referred to the Financial Ombudsman Service, further details of which can be found in out Listening to your comments leaflet.


    So at this stage,obviously im not too happy, ive waited long enough now and i want to complain to the Senior Manager, but not very good with legalities of the situation, so im looking for some info on how i can word a letter to him, telling him, if i dont receive a cheque for £1418, by the 26th of this month then i will be starting court proceedings to recover the full amount plus interest plus court costs.

    This is from an account i defaulted on, when i joined a debt management plan with Payplan, maybe the reason they are playing up with me.


    Just get the feeling its been a waste of time.


    My advice for anyone, is dont wait the 8 weeks, i had to, cos i couldnt afford to go to court, but i will be doing now, unless they settle.

    Six years is the maximum under the Limitation act although some people have been successful in getting more.

    It is 40 days not 40 working days, they should go and read their responsibilities under the Data Protection Act.
  • :confused: My husband and i have just received our personal bank statements from HSBC can any one tell me is it the TOTAL CHARGES i.e £100 as stated on our statement's that we can claim back it also says INTEREST i.e £17.51 is this the interest we claim back or do we calculate from the web site also says about NOTIFIED FEES/CHARGES do we claim these as well or not ?.Also what happens if we get our calculations are wrong after we have applied to the bank to refund our charges.

    I couldn't afford the £80 to take hsbc to court, I phoned a couple of times and was told about the 8 weeks they have to defend a complaint, my first letter was sent on the 12th Feb. A letter arrived dated 5th April offering £639 for full & final settlement up to 6 march 07. I've accepted, I originally asked for £610. It will take 7 days to be credited to my account I am so pleased but waiting until I see it before I celebrate! Also, whats the betting they just reduce my OD by £639 lol. Will keep you posted, but hold out anyone who's worried, I'm hopefully going to use the money to file my moneyclaim against cap one and monument!

    after initiating my claim back in Decmber against HSBC, I have had no response from the bank, so I'm now in the court system. I have entered my allocation questionnaire and only received one response from their solicitors asking for all the info i had already supplied to the Bank. I responded to this, mentioning I may be prepared to settle for the claim less interest but received no answer.

    After being transffered to my local court, I have since been notified that the bank had untill 2 April to file their allocation questionnaire, and have now been notified that "an allocation hearing will take place on 4 June"

    What does it all mean, and when will it end!

    Am I right in thinking the bank will probably settle before the hearing?

    Very surprised that they are even having an allocation hearing. Are you within the small claims jurisdiction (less than £5k)?

    Well it had to happen. There i was waiting til midnight to press the default button and HSBC have robbed me of the pleasure, i've just checked and they've registered a defence today. So what, i've waited this long a few more weeks will be worth it cos we can't let the bullies win. I have to admit knowing that i'm in the same boat as loads of people helps alot.

    To keep me busy a few weeks ago i applied for the statements of a credit card i had with HSBC that i closed a few years back. I should have done it all in one go but i wanted to see how this one went first.

    Is it true that we can go back beyond six years cos they wapped some massive charges on that credit card just over six years ago, i thought i had paid the card off and closed the ac but i noticed when i was calculating my current ac charges that the bank were still making payments to the card.

    Also i had a mothercare store card that i cleared and got rid of, does anyone know which bank they use and how i can track down my account number?

    1) Dont Send A Cheque!!!!! For The Statements
    2) Don't Take Them To Court Use The Fos (finiancal Ombudsman Service, It Takes Longer But Its Free!!!!!!!!!!
