    I have my court date for 15.06.07 I cannot believe this bank!!!

    Don't talk rubbish! By all means reclaim your charges that you got as per the terms and conditions for abusing your account but dont lie about what the charges are for!:rolleyes:

    Hi,
    You do realise you're just as entitled to everything beyond 6 years as we11, don't you.
    Six years just seems to be the time it's considered reasonable to expect someone to keep records, But Hey, just ask them for everything back till when you opened the account.. They've probably got that too, but the worst they can do is deny it - then it's up to you.

  • Kerry - I received mine in 72 envelopes from hsbc too but I sent them a cheque for £10 as per the standard letter and they sent it back saying they don't charge for this service. I then realised I had them all on line too!

    Good luck and keep us posted. (I am at MCOL stage now - they have until 23rd April to put in a defence)

    Firstly, thanks to all who have offered advice on here - its nice to know that we are not alone!!

    I've gone through MCOL and the bank filed a defence, basically saying that we agreed to the terms and conditions and charges which were laid out in their price list (don't remember seeing one of those!!). Northampton have transferred our claim to local county court, Watford. They have also dispensed with the AQ.

    However, as also posted here a few days ago, we received a letter from their solicitors asking for substantiation of our claim (which we sent them on Wednesday just gone) - so what's their game? If they were defending all charges on the claim outright, why would their solicitors be still asking for substantiation? It's all just mad mind games, isn't it....

    And the worst thing is, if I had let them keep to their reported timescales (6-8 weeks) without taking action, chances are it would be sorted by now on a more amicable basis. I feel quite sick by it all and sometimes wish we had never started this.

    So much for 22 years with the same bank!

    Has everyone heard about the barrister taking Natwest to court today over charges he incured while at Uni? He claiming £2500 plus damages! I think it may be land mark ruling time!! Am with HSBC but am so excited! Plus its Friday the 13th today! Unlucky for some, but on the whole, lucky for me! Fingers crossed dont you all think?

    Yes, Maisie it can be an arduous process but remember that if you'd waited the 8 weeks you may still only have received an offer which you may not have felt was enough and had to wait longer for a better one... at least this way you'll get what claim plus interest and get your costs back. Be positive and hang in there...

  • I am going to wait the 8 weeks, but this is mainly cos i can't afford court right now and i think i'd take a reasonable offer simply so i can take my other banki to court and the interest from that will offset what i may lose out on from HSBC...

    I've been hassling them a bit now - i called again yesterday and whilst they didnt give me any info I was able to find out that my 8 weeks started on the 9th March, so i'm at about week 5 right now and from the looks of other posts, I should hopefully hear something at the end of the month. I also sent them an e-note through my internet banking, they replied within 24 hours apologising and promising some urgency to be injected.

    It may not help, but it makes me feel better knowing that i've reminded them that i'm here!!

    HI im new to all this
    i sent my first letter asking for my charges plus instrest back on the 29 march to my local hsbc branch was that the rite place to send it too
    i as of yet have had no reply back to my letter i have had letters regarding the charges and wat will happen etc but no reply regarding my letter shud i hold off till next week as it was waster n that or shud i send it in as it has been two weeks tday since i posted the letter .

    I've just been told my claim could take 8 weeks. I hassled several hsbc staff members on the phone and got nowhere, so after 14 day's i'm going to ssmall claims court. Do the same if I were you. x

    Fliss M I think all are awaiting the outcome of this case; he was offered over and above what he was claiming (as I understand it ) but is claiming damages for the 'stress' caused (my word) over the yers due to these charges. IF he wins the ruling will only apply to NatWest in the first instance.
