I am a complete newbie in claiming bank charges back and I need advice.
My husband and I are currently with HSBC, and have been with them for over ten years. Over that period we have accumulated various accounts and packages, including a fixed rate morgage (which we are quite happy with). Unfortunately we have also managed to accumulate bank charges through mismanagement of current accounts.
I understand that the first step in reclaiming charges is to open a different account up, in case they demand closure of our original account. I don't particulary mind closure of our accounts but I would be concerned if we have to move morgages.
Would it be likely for them to demand this? If we had to swap where would I stand in reguards to the Early repayment charges? Would they apply if they forced us to move? (We haven't had any breachs with our repayments of the morgage or any loans)

It's highly unlikely they will mess with your mortgage if you are fully up to date with payments. It is covered under a seperate legal agreement and therefore should be safe from their wrath!0 -

hello just got on the money saving train and want to have a go at reclaim my bank charges. (they must owe me thousands lol)
i have my letter done to ask for a statment of the charges but am not sure where is best to send it. do i send it to my actual branch or do i send it to the addresses stated on this site. thanks for your help.A child smiles 500 times a day, compared to an adult over 25 smiling 15 times a day.0 -

The choice is yours. For the first letter (subject access request). The address in the sticky is straight to the Data Protection Controller who is the person that would deal with these requests.
For the next couple of letters (requesting your charges back, and letter before action), you can send these to your local branch.
If you need to issue a court claim. The address you need for the bank on the court papers is on the second post of the addresses thread (their registered address).
I recommend that you send all your letters by recorded or registered delivery. This way you have proof the bank received them.

Just downloaded the first letter to send off to HSBC. I am doing this to help my son. He struggles dreadfully financially as he suffers from a serious illness and has to live on a Disability Living Allowance. He has been crippled by his bank charges and although he tries to live within his limit, he is charged an average of 125 pounds per month for going over his overdraft limit. eg. at the end of this month he had 14 pounds left in his bank, the bank then took 125 pounds out (as he had been a few pounds overdrawn the previous month), making him overdrawn again, so therefore next month the same thing will happen.
My question is, how much of this 125 pounds are we allowed to ask for back that they have been charging him each month. Obviously they are allowed to charge for (what I imagine), is a kind of loan each month, but the ridiculous amount of 125 each time has meant he can never, ever get into credit. He has no credit cards, and doesn't owe anyone any money (thankfully), but just cannot live on the amount he has minus 125 each month.0 -
You can claim it all back, and if he has online banking, he will have access to his statements online.And yes the lady in the avatar is me

I've followed the recommended process in proceeding with a claim against my bank for the sum of £1412 before interest.
At the 14 day point i called my bank for an update and to confirm that they had received my recorded letter. They advise me that hadn't got round to my letter yet and that there is a 14 day backlog in claims so i should proceed in contacting my solicitor.
I'm starting to get twitchy now as the next step is the big one so can anyone advise on the following,
a. Is the bank trying to put me off by delaying any response to me ?
b. Should i start court proceedings now or wait the 14 days ?
c. Are they testing to see how serious i am ?
d. Has anyone else had the same situation and if so what was the result?

You don't need to phone them, if that was your first letter, proceed with your LBA. Stick to your timetable and ignore what they say unless it's an offer of full and unconditional refund.0
