  • Can anyone help, ive got a DR withdrawl from my account from 2001, all it says tho is "dr withdrawn £50" is this a charge?
  • ok,we do have another basic current account but it is in my husbands name only, but i think it will be ok to have just incase they close our account. it doesnt have the overdraft but his yearly bonus should be through in the next month and that will take care of a lot of the overdraft we have. im really worried we might lose and end up with legal fees or such like that we just cant afford. dont know if we are brave enough to take on a huge company like this, its just our luck that we will be in the minority and lose out altogether, but they owe us hundreds maybe thousands, and if they just helped in the first place we wouldnt be in this situation! im such a chicken lol!
  • Anyone got the address for Abbey customer services?

The chances of you losing are very small. A tiny proportion of cases have even got to court.

If your claim is under £5000, it should also be heard in the Small Claims track. This means unless you unless you really annoy the magistrate by completely ignoring procedures, it's extremely unlikely you would have to pay any legal fees, even by some very small chance you did lose!

I can understand you're scared, you wouldn't be the first. Please read the success stories on here. As long as you follow the procedure, you shouldn't have any problems.

I have a question. I have sent my letter off today asking for the charges back inc interest. Today i just realised they are about to charge me another £75 pounds which is due to be deducted on the 12th of next month. Can i claim this aswel? Or is it too late.
  • ok,gona do it,getting first letter sorted, gota be brave, mustnt let them win, time to get our own back for 3+ years of finacial worry, lol, they owe us our hard earned money and we want it back, they wouldnt let us forget if we took money from them unfairly would they!
  • Hi

I have been claiming my charges back since last November. I am claiming £655 plus interest plus court costs from HSBC. I have followed the instructions as set out on this site. I was offered £450 which I turned down, filled in the MCOL form and HSBC have defended their claim.

I received the AQ, which I filled in and posted (via courier) a couple of days ago. HSBC has filled in the defence section with their (what I am guessing) standard defence line and in the “other information” section (G) on the AQ I wrote asking the Judge to request that HSBC reveal their true costs.

I am now a bit lost. How long should I expect to wait for a reply from the court or HSBC? Is anyone else in the same boat? To be honest it is stressing me out a little but I am trying to sit tight. Is it normal for this to happen and what are the chances of it actually going to court (the whole thing has taken a lot longer than I thought it would an I would really appreciate some guidance on what happens next).

    Thanks.

If anyone could give me some guidance as to what happens next I would be really grateful. A,m really worried about this and don't want to go to court...(but I will if that is what it takes)

HSBC have never been to court to my knowledge. They should make you an offer before too long. It could be days, or they could wait until you get a court date and settle just before then.
