  • Just wondering if someone can give me a quick yes or no. If I claim on my current account and it is closed, can they also demand repayment of my credit card as both are with HSBC?
  • this is my first post, sorry its a long one,i am wanting to reclaim my charges from the past few years from HSBC but am worried,there are so many,it all started when our first daughter was born in 2003, we kept in close contact with the bank and voiced our concerns over and over but they wouldn't help, my husband was made redundant when our second daughter was just 4 months old, leading to a couple of harsh weeks, he was only out of work for a fortnight. now he gets an annual bonus each year, which they know, and it comes through the first week of april, yet last year we had bad month or two in jan feb time,when we asked the bank if we could have a temporary overdraft increase from £800 up to £1000 just to cover the DD's going out they refused, we told them that we would go over our overdraft as we had no extra monies to put in and they said the best they could do was remove our debit cards and cheque books to stop us spending more than we needed,but that they would definately charge us if we did go over our overdraft,helpful hey! we were getting charged over £100 per month every month and it got into a vicious circle that their charges were what was sending us over our limit mid month,so they were charging us for them sending us over again. i wrote to them last year trying to make them see sense, but they sent a letter back saying that it was our fault and live with it (basically) we got out of the charges using the bonus and borrowing from family and loans. they started refusing DD, :confused: the most daft one being their own,we had a loan with them, they took their payment out, then the next day put it back due to insuficient funds and charges us £30:mad: ! we dont yet have a second current account, and we are £1300 into our OD. we are worried that if they close the account we wont get another OD. has anyone had success claiming charges from HSBC and if so how far did it go. so nervous. does anyone think i may struggle to reclaim as the charges were obviously due to us over spending to start.
  • Today i received my statements for the last 6 years, or very near all of them, came in 30 letters :D

    Anyway ive gone through them, i take it im just looking for "dr".

    I can shred the ones without drs on i guess as i wont need them, but keep the ones with dr's on?

    Also like the previous post said, do i just do a spread sheet with headers

    This is something you need to look into and weigh up. If the refund of charges will not cover the overdraft and you cannot pay it off any other way, you may need to wait to claim.

    Unlikely if payments are up to date.

  • Hi Everyone,

    We made our claim at the beginning of january and not a lot has happened since then. Last week we received a letter from HSBC's solicitors asking for us to send them a breakdown of what we believe they owe us. Today we have received a court date from our local court asking for a further £100 fee and have been told that HSBC will be fighting the claim. Is this a normal procedure or have we gone wrong somewhere. We are now panicking a bit that we are going to lose and end up having to pay for HSBC's solicitors fees!
    Any advice or others experiences would be most appreciated.

    hiya, no real answer to you , but just to say i have just had letter from court saying natwest are defending all the claim i have made with them. I think we just have to go for it. its just our luck that we are the ones they are making wait, where as some are just being paid out. ! typical !

  • Hi

    I have been claiming my charges back since last November. I am claiming £655 plus interest plus court costs from HSBC. I have followed the instructions as set out on this site. I was offered £450 which I turned down, filled in the MCOL form and HSBC have defended their claim.

    I received the AQ, which I filled in and posted (via courier) a couple of days ago. HSBC has filled in the defence section with their (what I am guessing) standard defence line and in the “other information” section (G) on the AQ I wrote asking the Judge to request that HSBC reveal their true costs.

    I am now a bit lost. How long should I expect to wait for a reply from the court or HSBC? Is anyone else in the same boat? To be honest it is stressing me out a little but I am trying to sit tight. Is it normal for this to happen and what are the chances of it actually going to court (the whole thing has taken a lot longer than I thought it would an I would really appreciate some guidance on what happens next).

    I have received a letter today from HSBC stating that they are looking into my claim - this is day 10 of the 14 days to reply to my 1st letter requesting charges to be paid back. Do I have to wait til 14 days and if I dont hear anything else, file a small courts claim or should I call them before I start the court claim?
