Hi all,
I have been reading posts on here for 2 days now....after sending letters to 5 credit card companies asking for 6 years of statements.
I now realise, having read a lot of posts, that I should have sent them by recorded delivery. Should I resend the letters recorded with new cheques, or should I wait and see if any of them come up with the statements within 40 days?0 -
I also have another question.
I work for a government agency with the Forces out in Germany. BFPO address.
If I get to the court stage with any of the cards/banks I am claiming from....what court do I use?
Also, mail to BFPO takes a little longer on occasion to get out to us. Should I allow extra time for the companies to send stuff to me?
The 40 days should be plenty so Im not giving them extra on that, but when it comes to the 14 days and 7 days letters....do i allow an extra couple of days for them?0 -
After reading several posts it seems that HSBC will often send a letter asking you to give a breakdown of your charges even when you've submitted them. I was quite worried that I had messed up and even started to wonder if I'd forgotten to put them in the envelope with the letter. Best advice is to ignore this delaying tactic.0 -
Hi
hope I'm not repeating anything thats already been said. We have a current account with the hsbc which I would like to try to reclaim charges from however we also have a mortgage and a business account with them.Does anyone know how likely they would be to close any of these accounts down if we try to reclaim charges? Has anyone had accounts closed??? Thanks in advance x0 -

I'm sure MoneyClaim will help you with that when/IF you get to that stage.

Yes give extra time, the time scale should be taken from the date the bank is deemed to receive the letters so allow them those extra days.0 -
I recently went over my agreed overdraft limit due to a cheque being cashed, so the bank has charged me £25. I've read all the blurb on the website about getting any charges refunded so I felt pretty confident that I would get a refund.
I sent an email to my bank, stating that I thought the charge was excessive etc etc, and could I please have my money back, this was their responce;
"Whilst I do appreciate your comments regarding this matter, please be advised that customers can request overdrafts formally or informally. We may charge an Arrangement Fee for agreeing to overdraft requests.
This is a service fee for considering the overdraft request and providing customers with an overdraft. Kindly take note that the law you refer to only relates to penalties, as such we believe that the fee is legal, fair reasonable and transparent.
In this instance, I confirm that you have incurred GBP 25.00 informal arrangement fee on your bank account numbered 403915 71422588 during charging period 5 January 2007 to 4 February 2007 due to the following transaction:
18 January 2007 - GBP 508.79 request for an informal limit
Please note that we will charge an arrangement fee of GBP 25.00 every time you make a formal or informal overdraft request which we agree to. However, we promise that we will not charge arrangement fees for:
- Any formal or informal overdraft requests that we agree to, if this is the first time this has happened in the last six months.
- Small overdraft requests we agree to that are not more than GBP 10.00.
We will also not charge arrangement fees if debited arrangement fees or interest cause your account to go overdrawn or further overdrawn.
This charge has been correctly calculated and applied in accordance to the Bank’s standard tariff. This being the case, I regret that a refund will not be applicable on this occasion.
In order to avoid a similar situation occurring in future, I would suggest that you apply for an increased formal limit. If you would like to do this, please contact us via this messaging system or you may call us on 08457 404 404.
Please be advised that there will be a GBP 25.00 formal arrangement fee applicable for this request.
So is that it, is my arguement over? Please help, I'm new to all this....
Thanks,
Jenni0 -
Hi I need your help.
I will tell you a brief run down first
• I submitted first letter on 19th of January asking for £3511.76 (£2996.50+£515.26interest)
• I received standard stalling letter on the 2nd of February “we are looking into it)
• I submitted second letter on the 9th of February giving them 7days
• I phoned them on 16th of February asking what stage we are at they said they would have it sorted this week.
• Today I received offer letter saying interest is in not appropriate and the offer £2611 in full and final settlement.
The help I need is in deciding what to do next.
Is this a good offer that I should accept and take the money and run?
Or
Should put in a counter offer asking for the charges in full but not the interest
Or
Should I stay strong and fight for the lot.
In the good people of this forums opinion is it worth fighting on or do you think it could end up in court and I end up with nothing.
Help me pleaseMe

If you have not filed a court claim, you are not entitled to the interest.
You need to decide if this offer is fair. If so, accept it, otherwise, ask for the full amount (without interest) and. remind them if you need to file the claim, you will be adding the interest. You cannot 'hold out' for interest, the court would take a dim view if you were to turn down an offer of full payment.0 -

Send the letter in Martin's article, link in my signature, and stick with it. If you think you have other charges going back over the last 6 years ask for your statements and prepare a full claim.0
