Council move, not entitled to HB and running up huge debts!

  • This just doesn't sound right at all.

    Why do the council think that you need support and people to check up on you and charge you for this? If you are not at fault then you should not need to be paying for this.

    Have you researched your legal rights? Because you should be.

    I was recently rehoused due to harrassment by a neighbour and put into temporary accommodation and paid the same rent as before while the other party was evicted because it was the other party at fault.

    Is there more to this? What exactly has this neighbour done and why haven't you sought legal advice about him. There is a whole raft of legislation covering harrassment and anti-social behaviour. If three other households have been in the same situation then that would give you ample ammunition to seek recourse from him.

    Did you keep a diary or have any other evidence to support your accusations against him?

  • I can see why you are annoyed. It isnt fair that the innocent party in this situation has had to move.
    But your original question wasn't: "do you think it's unfair that a family have been moved out of their home due to someone else threatening us?" If that was your question then yes I think everyone would be in agreement with you there.
    But your question was: "are we liable to pay our current rent, because we are struggling compared to our previous lifestyle"
    I think what a lot of people here are saying is you aren't in a desperately awful situation, you have a good income and if it really unbarable you at least can afford to privately rent.
    But yes this is all a lot of hassle which you dont need especially with a newborn baby.
    Just wait it out and things will get better!
  • We had all the police reports. His house is a drinking and drug den which the police visit regularly. Basically because he has no legs due to his drinking the council said that he is not the person that you are at risk from, it's the people that go into his house but he was well known to them due to the problems from the other neighbour. The council basically said you can either move now and we will take your word for it and sort it out later or you stay until we gather all the evidence and put you through estate management which is basically where they move you into another property as soon as the investigation is closed - we were told this could take months so choose to move quickly.

    We didn't realise the implications but we were literally trapped in our house sitting with the lights off and having to phone the police constantly. It was dreadful.

    Anyway, at least you've only a few weeks until you get your inheritance.

    The inheritance is mostly for my kids. And the rest is pretty much already spent on a memorial plot for my children's gran and a wheelchair for my mother - I am going to have to use some of it to keep me off work for a little while longer too as I can't go back yet and due to some issues have messed up my SMP.

    If he is using his house (or is it a flat your posts confuse me) to deal drugs from or allow people to take drugs from and the police are aware and involved then that is grounds for eviction and I would be pursuing that if I was you.

    I can't help thinking that there is more to this than you are saying.
  • There genuinely isn't any more than I am posting. The police are aware of what is going on and have been for years but I think they seem to think it's easier to just move people on. Like I posted before, he will just do it somewhere else and the street we were in had a bit of a reputation anyway. We don't and I have asked about the extra support but it is a requirement of the accomodation

    Must you stay in Council/Local Authority housing? Could you not find a local landlord that allows pets and pay the going rate for rent and claim LHA/HB against that rent?

  • Just another thing, you can go into private rent and keep your homeless points open.

    I had a phone call yesterday from the housing officer who placed me in temp accommodation and asked how long the lease was for etc, she asked if I wanted to keep the housing application open as you are more than entitled to do so if you are moving from temporary accommodation as it free's it for someone else who needs it.

    If you go through an agency you can have a 6month contract and then go on a rolling month to month contract. As a single mother, albeit receiving benefits (although still contributing to rent) I'm a bit annoyed that
    a) you deem yourself entitled to a council house on such a large income, you only have the extra income due to the VERY reduced rent rent that you have had for however long. My rent is double what you paid for a 2 bedroom house.
    b) this is the reason that people who NEED council houses are unable to get them because even famililes with a decent income are expecting to have them to use.

    You are in a position to be able to private rent, do it, I can guarantee that you will be better off, much happier and have a larger surplus income and someoine who needs a council house much more than yourselves can have a roof over their head.
