    Well I am pretty horrified that you would need to ask about this!!!!

    Of course you contact the store with whom you placed your order and explain the situation. They should arrange with the supplier for the return of the excess that was delivered without charge to you.

    Are you one of those people who keep quiet when given too much change in shops, rather than pointing it out and handing the excess back????
  • Keep it at your own risk but there will be a paper trail of the error and it will probably be picked up when the accountants check the books - followed by a knock at your door. The answer is abvious you MUST at the very least contact them by writing and post using registered mail so you have proof you have contacted them and let them arrange uplift at their expense.

    I would keep it. But I would wait a while beforeb decorating or selling it :)

    I had a similar thing happen at xmas when I ordered a camcorder from a very well known online store - and two turned up! Did I send it back? Did I 'eck! It was a nice little touch.

    Nah im not a moral do-gooder. If this store can be so daft as to send so much extra, in my mind it justifys you keeping it!

    As Im sure you have already grasped. In law, from the moment you became aware of the error and made the decision to keep without informing the company it is Section 1 of the Theft Act.

    "A person is guilty of theft if he/she DISHONESTLY appropriates property belonging to another, with the INTENTION of permanently depriving that person of it"

    Cut and dry really. However, if you have emailed / called them to advise, then the INTENTION to permanently deprive is no longer there but you will be unable to sell them on as when you do the INTENTION to permantly deprive them comes back into play.

    A very similar question came up in a Sargents exam many moons ago. (Ahhh happy days!!!)

    For me though, I would writing them a letter (recorded delivery) stating they have 14 days to collect and after this date, if not collected then you will be charging them a storage fee and admin fees of say £10/15 per day, and if no payment received you will be issuing court proceedings to recover. Trust me, if it gets this far you will be adequately compensated by the Court as you have fulfilled your obligation.

  • You need to phone them, tell them what's happened, say they have 2 weeks to collect it or you'll have no alternative but to dispose of it. That is reasonable. You can't be expected to store it indefinitely. You are asking because you know it would be dishonest to keep it...who knows they may tell you to keep it. Whatever, you can then live with a clear conscience.
  • yes, of course you must at least try to return it. If you don't, every time you look at your lovely new wallpaper you will be wracked by guilt and not able to enjoy it. The very fact that you are worried proves you are an honest person......
    I believe you can do the following:

    Email them informing them of what has happened. Say that you would like them to come to collect the extra rolls at a time that is convenient to you. Also say that if you don't get a response from them within 7 days that you will assume the extra goods are now yours.

    I was advised by a solicitor to use this tactic in the past when I received unsolicited products e.g. books from book clubs after I had canceled membership. It worked every time. They never replied. I got free books (or whatever) they stopped sending me unsolicited goods!

    Result.
  • legal shmeegal, this is an issue of your morality :A not legality!

    Whilst legally you MAY be entitled to keep them as an unsolicited gift it's not going to be giving you any warm fuzzies inside is it??! Take the moral high ground here, there's no reason you should be used as an unpaid storage facility for 3-6 months (otherwise known as a schmuck) but still, give them a chance to get it back!

    Email the store (who your sales contract is with) telling them about the extra roles, clearly state you believe 2 weeks is an adequate time for them to get somebody to collect them (if a company offers next day/2-3 day delivery then 14 days to rectify their mistake is absolutely adequate) and that after that 2 week period you will dispose of those good in any way you chose (use/bin/sell)

    If you feel this is a bit harsh (it's not) how about some extra warm fuzzies and after the 2 weeks, instead of any personal gain you could have a call around and see if any charities, carehomes, childcare centres etc would appreciate a donation of lots of wallpaper :j

  • There shouldn't be a dilemma, if you are an honest person. Inform them in writing or by email that they have delivered more than you ordered, and keep it for them to come and collect.

  • Someone is going to be paying for this wallpaper somewhere along the line. You should contact the supplier, point out the mistake and wait for them to collect it.
