    The Money Claim form does have its little idiosyncrasies. However, its a doddle compared to some online job applications forms I've had to fill in.

    Here's my history for peope who like to compare notes...

    15-03-07 Request sent for six years statements with £10 cheque.
    17-03-07 Cheque cashed.
    15-04-07 Over six years of statements arrived
    17-04-07 Sent first template letter requesting return of charges plus interest
    21-04-07 Standard reply letter from A&L saying 'no'
    23-04-07 Second template letter giving 14 days before court action
    25-04-07 A&L sign for second letter
    09-05-07 As no contact from A&L, I called them and asked if they wished to pay the full ammount before I file with the courts, not interested, so I filed.

    I sent all my letters to Bootle but put the Leicester address on the MCOL form. I can imagine that some people will be worried by this banks tough posturing but we shouldn't let it scare us off.
    Fingers crossed for no defence and a quick payout but I guess that's unlikely.
    I'll keep you all posted and look forward to hearing how everyone else fairs.

    I'm just curious, do A+L actually go to court? I mean theres a few of us now about to go to court, what usually happens? Do they settle a day or 2 before court? Do they turn up at court? Do they not turn up?

    What actually happens?

    I'd love to know myself (as all of us would:rolleyes:). Unfortunately, there seem to be many of us at similar stages, so not sure you'll get an answer. In the success thread, there are some earlier instances of A&L paying up after 1 or 2 letters, but they seem to have changed their tactics now and are really dragging it out to try and frighten us into giving up.

    I started with the letter requesting 6 years of my statements in January 07, enclosing £10.
    I waited patiently to near the 40 days, I rang them just before and they said they were in the post. They arrived a few days later, so I sat down to go through them making a note of the charges.
    Everything was going fine and then the statements jumped from 20 October 2005 to 20 April 2006, there were 5 statements missing. I got angry, I telephoned A&L on 10 March, got an apology and they said they would send them out.
    2 weeks past and then I received a letter asking me for another £10, I wasn't happy so I phoned them again, the woman I spoke to said sorry, I didn't have to pay another £10 and they would send them out to me.
    Still nothing I sent them the letter saying they were in breach and I would inform the information commission office, then wrote another letter, another phone call last week, and woman said there was no record down on the computer, still nothing so I phoned again today, this time the lady on the phone said she would keep me on hold while she wrote the details on the computer. She then said she will ring me tomorrow to let me know of the outcome.
    This has taken 4 months just to get my statements, what a pain, but I am not going to give up. They have taken about £800 of my money of 6 years and I have put up with and why should we.
    If I don't get the missed statements, does anyone know what I should do. Please help.

    They're playing funny b*****s with me as well. I've just sent them a letter threatening them with the information commissioner, given them an alternative date and then told them I will have no alternative but to file for the maximum amount under the small claims as they have failed to provide the documentation. I wouldn't mind, but they know as well as I do that my claim will probably be for about £5k anyway as I've got four years worth of statements and therefore, only waiting for the first two and I'm well over £3k with the statements I've got. So not sure if this threat will work in my case, but I'd rather get things moving and then pay £35 to change the amount on the court claim. However, my son is a different story. I sent the same letter but his claim is probably about half of mine, so I don't know if the threat of a higher claim will move their pretty little butts any faster.......ha...who am I trying to kid??

    That's terrible .. what a load of hassle for youicon9.gif There's no way it should have taken this long, even if they are using delay tactics:rolleyes: I'm pretty sure it's the Information Commissioner you report them to if you don't get the information you're entitled to (especially if you've paid). Under the Data Protection Act, sounds as if they're acting unlawfully. Not quite sure how you'd go about this, you could either ask on this forum or go directly to their web site.

    What did everyone send in regards to Clause 10 of the defence?

    I've printed off my spreadsheet again - which has the amount when i started my claim - and am going to send it to A&L Wragge & Co. and Should i send it to Northampton Court or wait for it to be transferred?

    Anyone got a nice letter that they used when sending it?

    Eyeball, I just sent Wragge & Co. the detailed schedule with 8% interest, stating that I'd already sent this to the bank ... hope this clarifies my claim, and, if there's anything further I can help them with, to let me know. I also rang Northampton and they asked if I'd email it to them, so I'd give them a ring.icon7.gif
