  • Can you take them to court if you don't know how much they have taken of you? I have got online banking so can probably get some copy statements of there, but maybe not 6 years worth. In the letter they have sent me they haven't even acknowledged the fact I asked for statements.

    Ah right I thought you had already got your statements. They have 40 days to produce the information/statement required and if you don't get them in that time scale you then have to report them to the ICO and keep pestering until you get the information then you can start your claim off.

    hi all,i sent a&l the fifth letter stating that i intend to claim the full amount including interest up to the date of judgement, had a reply 2day stating that they are currently looking into it and i will have a response from them a.s.a.p i gave them 14 days for them to reply,which they did,the question now is "how long do i wait for them to answer my request for the amount of charges? or do i just carry on and issue the sixth letter and take a&l to court?please can anyone advice me!!

    I am now at the letter 3 stage with A&L in that court action (small claims) is threatened and as yet have not received any reply, but still within 14 working days. Although their original correspondance with me eg statements and then refusal were received very quickly,I am not hopeful that the 3rd letter will shift them, so I am preparing myself to go down the small claims procedure route, has anyone gone this far with this bank through Scottish small claims and if so what was the outcome? I am also experiencing the same sort of response from Monument credit cards who have sent me a final response letter, I am assumming the samll claims action is now apparent re them?

    Help please starting to get worried and bit scared?
  • Thank you Edinburghlass for that info, avoided us making a potentially costly mistake.
    We are in the same position as most of you as sixxdog-UK aptly put it, waiting for the next stage in the dance. So just waiting for the bank to cut in with the money or court papers to drop.

    Congratulations pinkysmum and may I say if it wasnt for all of the contributors, the person Im helping to claim may have just accepted the first cheque. Its important we tell as many people as possible about this site and how to claim. The rich b-ankers are not being generous offering us titbits - it's OUR money, ALL of it and we want it BACK!!

    hi all, i wrote to a&l stating that i have not had a satisfactory response from them as according to them the charges are fair.therefore i intend to claim the full amount including interest up to the date of judgement an the fees of the court.they replied they are currently looking into it and i will have a response a.s.a.p... how long do i wait for their decision? or do i just wait for the 14 days and then start the court proceedings? your advice will be appreciated thanks.

    A&L ignored me untill I sent the letters via recorded delivery (then they couldn't claim they hadn't recieved it!!) Strangely, 5 days later I got a response!! I still wasn't hapy with the repsonse so I'm going through court proceedings. They will send you usual patter about "the change in law relating to credit cards only" and "we made you aware of the charges at the the start". Be prepared to start court proceedings!

    Unless they have moved the current account office from Bootle in past 2 yesrs, the Narborough address is for Mortgage Accounts only!!

    i am one stage away from the courts i am prepared to start the proceedings they have replied to my fifth letter saying that they are looking into it and i will hear from them asap the 14 days are up on the15 may if i do not hear from them by then do i start the proceedings there and then or do i give them more time

    You can always phone the telephone banking line and speak to somebody on the 15th. If they have made a decision, it will be on the system and somebody WILL be able to tell you if they have dealt with your query. They might not be able to tell you the contents of any reply, but they will be able to tell you if its been replied too. If they can't give you that info over the phone, don't get angry or threaten the telephone operator or tell them what your intending to do as they will mark this on your account. Just fill in the form and take them to court.
