Is this the actual 6 page defence letter you've received? If yes, do they state you have not particularised your claim (clause 10)? HI MimiJane - no its only 2 pages. Covering letter saying we enclose a copy of A&L Acknowledgement of Service giving notice of intention to defend. And a page called Response Pack. Any idea what I do now?0 -

Just sit back and wait for their defence to arrive (if it does) and then follow the steps above. If you don't get the clause that most of us have re. "not particularising the claim", I don't think you'll have to submit anything to them, unless specifically requested to.

i am still waiting for a court date to be issued. can someone make up a list of what documents they have prepared to take to court and what to say etc. is their any templates?

Thunnisett, you need the court bundle download from CAG website . It's got all the goodies there, case law including the infamous Dunlop case, UTCCR 1999, UCTA 1977 etc. It is basically ready to go, all you have to do is customise it with your own circumstances. i.e. your own correspondence.

has anyone had any dealings with the alliance and leicester and trying to claim charges back. completed steps one and two ok, they wrote back fobbing me off saying their charges legal , i wrote back threatening court action has any one else had any luck with them.. :beer:0

Hiya,
A&L are notorious for stringing it out to the bitter end and forcing you into the court process. However, there are some stories on the A&L thread that inidicate they are making offers for the difference between £12 and £20. I'm also with A&L and I'm not taking any chances. I know that whatever they offer me, it won't be anywhere near the amount they owe me and I'm ready for my day in court (so to speak). Go get 'em:dance: Proud to be dealing with my debts0 -

I am currently in the court process with Abbey but for oh claimin at A & l.I havent recieved my statements yet and it must be at least 6 weeks since i sent my £10 off. Have sent another letter this week demanding the statements seems like i have picked the 2 worse banks to ask for my charges back lol.

Its a bit drawn out with A&L, they will probably acknowledge the claim, then file a defence through their solicitors (most threads mention that Wragges & Co are defending).
In the defence it may state (paragraph 10) that you havent particularised your claim properly, if at all, blah blah blinking blah. This is due to you filing online and having limited space to enter particulars of claim. At this point it is advised to re-send your spreadsheet of charges to both the A&L and the defending solicitors.
Its just legal blah, blah, but just send it in case (in theory a case could be struck out if the defence doesn't receive a particularised claim).
