    hmm, strange that its the weekend you receive it isnt it? A whole 3 days to wonder what A & L are up to.
  • filed claim on 30/4/07. received 2 letters today 1 from A&L solicitors stating they will defend all of the claim and 1 from A&L saying they are refunding all charges claimed and cheque enclosed. The amount i am claiming is £3676 and letter from A&L states cheque enclosed for £3676, however the cheque amount is only for £1065.50. i have rang A&L this morning and was told the amount on the letter must be wrong and that they will only pay the £1065.50. i have emailed them and refused offer, can anyone tell me what to do with the cheque i have now.

    If you cash it then you are deemed to have accepted it.

    Really you have two choices. You can either send it back to them (after having made a photocopy) with a polite letter telling them where to shove it (I'd recommend keeping biological terms to a minimum).

    Or you can keep it and use it as a possible defence, i.e. if the bank truly thought the charges were fair and lawful then why would they refund any of it, goodwill or otherwise?

    Wragge & Co indeed .... I have had a change of heart so I sent Wragge & Co another copy of my spreadsheet charges 'PARTICULARISED' both by e-mail and recorded signed for delivery. I had sent it to Carlton Park but something niggled me about not sending it to Wragges so I have this morning.

    By the way, i made the spreadsheet password protected so it cant be altered in any way. Im not in any way suggesting solicitors would alter any content of an e-mail as they are such an honourable profession, but an unprotected document could easily be altered in the wrong hands.

    Ho hum, waiting for a cheque or the questionnaire now. By the way, anybody else get the impression that bank bigwigs and solicitors acting for them use this and other sites? When they realise we know what they will try next, they alter tactics, and try plan B, or plan z.

    Hmmm kinda cynical aren't I?

  • has anyone been sent a cheque that isnt for the full amount claimed, received one this morning from alliance &leicester for £1009 but total charges are £3656. ive refused this as ive already filed claim, can i keep this cheque as part payment. Incidently recieved letter also today to say A&L are defending all of the claim. the letter that came with the cheque said find enclosed cheque for £3656 but was only for £1009. i rang bank and they said it must be a mistake and we are only offering £1009. any advice appreciated

    The safest option would be to send the cheque back (don't forget to photocopy it first) telling them that you don't accept their offer.

    Alternatively send them a letter, before you cash the cheque, stating categorically that you are accepting the monies unconditionally and purely as part payment for your main claim. Wait until you get a response from that letter before you cash it.

    Personally I'd go for the first option as it can't come back and bite you in the bum from a legal standpoint.

    Yep, I think you are probably correct, Rob. Some Junior, somewhere has been told to keep tabs on us 'rebels'.Noticed that the letter from wragge & co was signed by a trainee solicitor, so they have got their top people on the job! Lets wait and see what they have up their sleeves next, how many hoops can they make us jump through before the inevitable happens, and we get our money back.:T :T :T :T :T :T :T

    I think A&L set out to confuse me not that it takes much! Court proceedings started on 2 May and Saturday 5 May I received a letter from them enclosing a cheque for £328.50 (I'm claiming £1600) as a means to resolving the matter. They also state "Default charges may apply to current accounts when items are presented for payment whilst the account is in excess of its overdraft limit and are returned unpaid (bounced) and a fee is charged. We do not believe that the term applies to other types of fee." Also, on the same day I received a letter from Wragg & Co stating that they intend to defend my claim. What do I do now? Do I send the cheque back to A&L or Wraggs telling them politely to stuff it? Do I have to tell the court that I am declining the banks offer and wish to proceed. :confused:

    The cheque was sent from A&L, so write back to them saying they may not be aware you're started court proceedings and you are pursuing the full amount owed to you through the court system, so return their cheque, blah, blah.

    Nothing has changed regarding your claim through the court, so no need to notify them, just carry on with the claim.

    In a short while, you should receive A&L's defence which will be exactly what many of us have received recently.:rolleyes: At this stage, just sit back and wait for a court date (which is the stage I'm at).

    I'm going to claim my bank charges back from Alliance and Leicester but I am unsure if you can claim if you closed the account. I was so incensed by charges applied to my account and the way I was dealt with that I closed my account in 2006. Does anyone know if I can still reclaim the charges?
