hi can anyone help me i am trying to find out wether you send your summons to the bank branch or to the head office could anyone help because i am at the stage were we have been messed about for ages by our bank ,help!0

Hi everyone,
I was claiming for £4325 plus charges this was for 6 years, went to see solicitor about sending letters to A & L, if it was to go to court I would only be able to claim 5 years because of scottish laws, so it would off worked out less.
But hey to my suprise this morning I received a letter from A&L saying
"Our records show that over the last six years, charges totalling £4325 have been applied to your account, Whilst I am confident that we have acted correctly in accordance with our charging policy blah blah blah!! I am willing to make a goodwill gesture and am prepared to offer a refund of £3000, please sign and return if you accept."
So im delighted as I think thats a not bad offer considering I included service charges too. So Im going to accept.
I just sent The standard letters from this site and never started court proceedings yet....

The only communication I've had from A&L since I started court proceedings, arrived the day after the final date they could have responded by. And it was the usual standard letter saying they were within their rights to make these default charges, blah, blah, blah. Oddly, they quoted a different bank account number to mine and then later in the letter contradict themselves by saying there was "no evidence of any unpaid item charges having been debited to your account"! I'm sure they must have got me confused with someone else as the letter they sent was dated 50 days after my final threat to take them to court and is the only letter I've received from them since .
Looks like they're in a spin with all these claims :rotfl:
In spite of getting this far, I still feel they're going to crawl out of paying up, though I don't see how, as they did not respond to the claim through the court.
I await the postman nervously each day.
I got an "Acknowledgement of Service" letter today from Wragg & Co. dated 2 May.
A&L had until 29 April to respond to my claim. I was unable to request a judgment in my favour until 1 May (The Money Claim Online site wouldn't let me, saying I couldn't do it yet - maybe because 29 April was a Sunday).
I'm assuming A&L were too late to respond, as I've been allowed to proceed with issuing the warrant for payment. I've paid the £55 for issuing the warrant and am now just waiting for the court to give it a final validation.
Is there anything that can go wrong now? And have A&L and Wragg left it too late to contest the claim?
Has anyone got any comments to ease my nerves?0 -
Hi i am claiming £4320 +£120 this includes interest and online court fee.
today i have recieved a letter of acknowledgement of services with the intention to defend from Wragg&Co solicitors (A&L),
i think they have 28 days to file a defence ( 2/5/07).
has anyone been in this position with a claim against the A&L and if so what happens next.

Take a look back thru the past 2-3 pages of this thread.
There are about 5 of us in a similar position.
The next thing to drop thru your letterbox is a 5-6 page defence.

I too have received notification that A & L are defending my claim. Is this a recent change in tactics? Notification on May 2nd, looks like they have sent out a batch all together, lets hope we are all successful in our claims!:j :j :j :j0
