    I guess the next step is receiving an Allocation Questionnaire from the court though, on the whole, they seem to be dispensing with them. We have to pay £100 apparently whether or not we receive one (reclaimable from the bank). There's lots of good info. on the CAG site as to what to do at this point. Even if an AQ is not received, there are suggestions of letters to send to the court and templates to send to the bank to "nudge" them into paying up sooner rather than later.:rolleyes:

    Of course, there's a strong probability the bank will pay up along the way ... fingers crossed.;)

    I origanally added up my charges for 6 years, so the solicitor is sending of for that first to see what happens, but when it does come to going to court it will be for the last five years.

    I've a business account with A&L, and they have not contested the claim I made through Money Claim Online for £2959.64 inc. interest. I've now requested a judgment by default.

    The only communication I've had from A&L since I started court proceedings, arrived the day after the final date they could have responded by. And it was the usual standard letter saying they were within their rights to make these default charges, blah, blah, blah. Oddly, they quoted a different bank account number to mine and then later in the letter contradict themselves by saying there was "no evidence of any unpaid item charges having been debited to your account"! I'm sure they must have got me confused with someone else as the letter they sent was dated 50 days after my final threat to take them to court and is the only letter I've received from them since .

    Looks like they're in a spin with all these claims :rotfl:

    In spite of getting this far, I still feel they're going to crawl out of paying up, though I don't see how, as they did not respond to the claim through the court.

    I await the postman nervously each day.

    MimiJane soz i was getting confused, i received the 6 pages from wragge and co yesterday morning so now i guess just have to wait and see what happens next, i'll keep you all posted.

    I have two cases against Alliance & Leicester, one for the credit card, the other for the bank account.

    Credit Card - claiming £256.54 inc. interest
    Bank Account - claiming £596.32 incl. interest

    The GOOD news is that this morning I had a letter regarding the credit card amount, saying they will credit my account with the full amount (yipppppeeeeeee!!). So no big fat cheque, just means I owe them less money, but that's good too!

    The not so good news is I received another letter from Wragge & Co containing A&L's defence for the bank account claim :(

    Two questions, first is, as they settled out of court for the credit card do I lose my court fee?

    Second is, now I have a copy of the defence, what do I do next?

    Feeling like I'm getting somewhere, though it ain't over yet!

    No problem, it's very easy to get confused with all this paperwork coming through so fast:rolleyes:

    Really hope A&L get moving and start to send cheques out before we have to start filling in forms/writing to the court/preparing court bundles, etc. I let you know what happens next.

    I think that, if you start court proceedings, they're obliged to refund your court fee. Now you have a copy of the defence, the general advice is to do nothing just yet, so you don't furnish them with information they don't need yet and may use in their defence. If you do want to reply, just send them another copy of your charges and interest schedule and say you trust this answers any queries they have.icon7.gif

    Hi All,

    I too got my standard 6 page defence today no big surprise there.

    I also got a reply from my letter to wragge & co , basicly saying .

    (1) They reject my offer to settle for 1700 quid
    (2) Alliance & Leicester repeat their offer of £264.50 !!! (Yeah right¬!!!)
    (3) The bank again assure me that no account closure is being considered.

    blaH BLAH BLAH...........

    MORE INTERESTINGLY thou.

    I contacted the court regarding the defence to be told that they had not received it , and under county court law the defendant is bound to serve this to the court NOT to the claimant as is suggested in the cover letter that came with the defence from wragge & co. So much so , that if they do not file it within 28days even thou they have sent a copy to us it is still not recognised and we win by default.

    Furthermore , the Northampton County Court district judge has ruled that Allocation Questionnaires are NOT required for bank charge cases , and the next step is relocation to our local courts , (£100 fee if claim is over £1500 , not payable to those in recipt of some state benfits , ask for form EX160) , followed by court date. :rotfl:

    Sooooo no big court bundles to prepair as yet and no AQ's to fill out.

    The clerk of the court indicated strongly that the judges are seeing the AQ's as a waste of time and money , as the cases never go to court.

    ALSO , they hinted strongly that even if a court date is set , they never show up , (AS YET).


    Sooooooo again it's wait and see , sit tight and keep each other informed.

    oh has anyone actually added up their fee's @£12 a go , with no interest? i did , it makes for interesting reading, and as it's part of the A&L's defence you would have thought they would have at least used a calculator!! :) hehehe

    I wonder how much each letter from Wragge & Co. to us costs the A&L?

    I suggest we all keep writing to wragge's with letters repeating our case and mundane information they already have to see how much we can cost 'em :)

    If it get's tooo costly , maybe they'll throw in the towel ;)

    just an idea.

    Firstly we have received a letter from alliance and leicester stating that there charges are fair and they are refusing our request. can anyone tell me how long a court claim can take.

    Also hsbc have said they have'nt received our letter asking for bank statements (even though we sent it) and that we'd have to wait a further fourty days !!:mad:
    do we have the right to complain as our patience is really running thin.
    any advice would be much appreciated.
