    Firstly if you kept a copy of your original request letter report them to the information commissioner.

    Personally I recommend you go into your local branch I did with the Halifax and not only did the statement arrive within seven days but it didn't cost a penny.

    There is no avoiding the fact that the court procedure will take time this all depends on how quick you bank respond but in the best case they may not even acknowledge within the 14 days and you can request judgement.

    Good Luck and remember deal with this in a way thats best for you

    A bit of further info. for everybody on the AQ : On reading through the threads on the CAG website, in some cases, although the AQ is not being sent out by Northampton court, your local court might still request one when proceedings have been transferred ... it depends entirely on the thoughts of the judge. Either way, no problem, as there are templates on this site and the CAG oneicon7.gif

    Right it finally arrived, I got a letter from Wragge & Co, saying:

    We enclose for you information a copy of the notice of dispute together with the form of Defence, as we have filed on our clients behalf in tonights post with the Belfast County Court

    Do I need to do anything with this letter? Also what happens next. I phoned the court and they no nothing, letter dated 29th so it would of been processed by now

    No, just sit tight to wait to hear from the court ... don't give them any info. they don't need yet and can use against you.icon7.gif

  • I have two cases against Alliance & Leicester, one for the credit card, the other for the bank account.

    Credit Card - claiming £256.54 inc. interest
    Bank Account - claiming £596.32 incl. interest

    The GOOD news is that this morning I had a letter regarding the credit card amount, saying they will credit my account with the full amount (yipppppeeeeeee!!). So no big fat cheque, just means I owe them less money, but that's good too!

    The not so good news is I received another letter from Wragge & Co containing A&L's defence for the bank account claim :(

    Two questions, first is, as they settled out of court for the credit card do I lose my court fee?

    Second is, now I have a copy of the defence, what do I do next?

    Feeling like I'm getting somewhere, though it ain't over yet!

    Hi all,

    Just had a read of my sister's defence letter (who I'm claiming for). Clause 10 states the following :-

    "The claimant has failed to particularise the claim against the defendent adequately or at all and the claimant is requested to particularise each and every charge that the claimant alleges the defendent has added to the account, specifying the amount charged, the dates of the charge and the explanation given for the charge".

    Clause 11 :

    "The defendent repeats paragraph 2 above."

    Has everyone else got these paragraphs included in their defence? Just wondering if it's a good idea to the list of charges to the solicitors (already sent to the bank).

    How can you particularise every claim when they will have just put 'Upaid Item Charge' or something...? Doesnt make sense. Maybe call MCOL and ask them?

    - Standard Reply
    - 23/04/07 MCOL claim started
    - 27/04/07 - Offer received & rejected
    - 28/04/07 - Letter fromA&L Solicitors stating intention to defend

    HSBC - 1st letter requesting money sent 07/03
    - Standard Reply

    - 2nd letter requesting money sent 21/03
    - 01/05 Received Offer for good amount

    Thanks eyeball. From experience, the courts won't advise on matters like this. I may just send the solicitors the list of charges and point out the very relevant fact that you've made.:rolleyes:

    When did you get the defence? If it's only in the last few days, it's probably on it's way to the court. Have they gone over their deadline date?
