    I will do, it's comforting to read others are at the same stage etc. Mimi jane, that is one looonnnnng defence, i only had 1 page, seemed just like a general letter from them.

    Hope we will soon all be sharing our good news that we have received our claims back in full !!

    Hi Guys,

    Just thought I'd update you wats happening with my claim.:rolleyes:
    Since im in Scotland and is claiming over £4000 and none of the threatening letters have worked, , I was advised to get help from a solicitor, so done that last Thursday, They told me if I wanted to take A & L to court I would have to get a solicitor because of how much I am claiming and scottish laws and all that.:confused:
    But first they are going to send a letter from them to ask for money, before going to court, as he thinks this might make a difference getting a letter from a solicitor because they know that people are getting the standard letters from various web site's.
    Anyway it is going to cost a bit If I do have to take them to court, so lets hope that I would win so I can claim court and solicitor fees back:doh:

    Hi, My wife is having problems with A&L, We wrote to them asking for a list of charges and included a £10 cheque which they have cashed (no suprise there huh?) This was on the 30th of january, after multiple calls and many broken promises from the bank we have Complained to the ICO.

    So what do we do now?

    Edit to add,to clarify we still have not recieved the list of charges

    after 7 letters sent so far A&l have only offered £152 out of £1500 (of course without predjudice) now theyve instructed solicitors and made a defence to the claim. Is this normal? will A&L go to court or are they bluffing? solicitors have even written contesting that they havent received a 'particularised claim' despite me sending a detailed 7 page spreadsheet. Any advice?

    Hi exactly the same ... claiming £1500, got a cheque through for £152. refused, and got a 6 page defence from Wragge and co for Northampton court. Have to wait and see eh?

    Hi guys,

    I've filed a case against the A&L for £1580.51 inc interest and charges £1700.51.

    2 days after they were served i got a letter a cheque for £264 !!! they got the following reply.........

    Dear Sir or Madam, (cc. Customer Complaints Carlton Park Office)

    Account number: *************
    RE : County Court Case : Wilson V. Alliance & Leicester PLC : ********

    I am writing with reference to default charges applied to my account amounting to £1580.51, which I have requested you pay back. This figure is now £1700.51 including interest & court costs.

    With reference to your letter dated 24th April 2007 in which you enclosed an offer and a cheque for the sum of £264.50, this offer is no where near acceptable.

    Considering the long period in which you unlawfully imposed excessive punitive charges to my account this offer is nothing short of an insult and serves to do nothing more than highlight the contempt in which you hold your customers.

    This letter serves as an official rejection of this offer and I would again reiterate that unless the sum of £1700.51 , is repaid to me within the next 7 days , I will not retract my legal action and will allow the courts to decide the outcome of this case.

    The cheque that you sent to me for £264.50 has been endorsed as CANCELLED and is enclosed. (Copy Enclosed for Carlton Park Office)

    Once again I would point out that if the FULL AMOUNT of £1700.51 is refunded to me in the next 7 Days I will withdraw my court action against Alliance & Leicester PLC.

    With reference to the comments you make regarding closure of customers accounts and your assurance that my account will not be closed if I was to accept the offer you have made.

    I see this as nothing less than a threat of more punitive action designed to cause me financial difficulties by withholding banking services from me.

    I would point out that in recent cases presented to the Financial Ombudsman Service, where customers’ accounts have been closed down after reclaiming bank charges, the Ombudsman deemed this as unfair practice and issued compensatory payments to be made of £200 and £175 respectively.

    I acknowledge the banks wish to keep me as a customer and assurance that my account remains open and would reiterate in the strongest possible terms that unless £1700.51 is refunded to me within 7 days and my account remains open, I will have no choice but to remain committed to the legal case already filed against you.

    Furthermore if punitive measures such as account closure follow I will not hesitate to file an official complaint with the Financial Ombudsman Service with a view to claiming compensation for such actions.

    I am sorry that this matter still has not reached a satisfactory outcome and would urge the bank to see my point of view, as a customer most of my adult life I feel that the bank has had it’s fair share of income from me and that my loyalty to the bank over this extended period of time warrants a degree of respect.

    The matter of the £264.50 offer is appalling , if I was to borrow £1700 from you and said ‘Oh sorry I only feel like paying £264 back’ would that be fair? NO.

    I would close by again stating that the only way to avoid this matter proceeding to a court date is to repay £1700.51 in the next 7 days.

    I look forward for a full response to this letter.

    Is it the notice to defend or the actual defence you've had? From reading the CAG forum, A&L's defence is normally 6 pages long

    Alliance & Leicester have got the hump and don't want to play nice now , they have sent out the dogs to have a go.......:mad:

    Got a letter of acknowledgement from Wragge & Co. LLP today in which it states that the A&L intend to defend the claim...... Surprise Surprise!!!

    The solicitors don't have to send copies of the acknowledgement to the claimant the court do this, i just assume this is another scare tactic trying to make us cave in.

    I am willing to make a token reduction in the amount that I will accept.

    I am willing to settle out of court for a sum of £1700 in full and final settlement of this matter.

    This offer is subject to a 7 day period and is non negotiable.

    I would also like to make clear that any further punitive action, such as account closure will be reported immediately to the Financial Ombudsman Service for consideration.

    This offer is made without any prejudice and/or admission of liability that may or may not preclude or inhibit evidence that may later be used in court.

    heheh I thought the token gesture of a 0.51p reduction in my claim was an equal and appropriate insulting offer in response to the £264 quid they had previously offered me!!!

    What the banks fail to get it that we have already been deprived of this money and have nothing to lose.

    Anyway keep up the good fight guys I'll keep you posted.

    I think we are all at the same stage too.
    All having received a 6/7 page defence from Wragge & Co (who must be getting rich over all this court action!!)

    I guess its just a matter of sitting tight.
