    My letter was from a fully fledged solictor, not a trainee.

    Although maybe the trainee should have done it as they have my house number incorrect and my neighbours need to bring their letters around!!

    :eek: Can anyone tell me about the Fast track & Multi track court system. When I checked out the courts website it appears to me I will have to wait about 30 weeks before a court cases is set. Also for these case where over £5000 is being claimed I will need to put together what looks like complicated cases papers. Can anyone clarify the procedure.

    Also there seems to be a lot of upfront fees apart from the initial £250 fee for claims over £5000. If I have this right it works out about £800 in court fees.

    I'm at the stage where I've sent A&L a letter stating I will take court action and am waiting their rejection letter.

    Is it true that Alliance and Leicester have announced that it only costs around £4.50 for someone going overdrawn, and that they would be refunding people?

    the problem i have is as follows,

    a number of years ago, about 2002/03, I ran into financial difficulty with the Allaince & Leciester, I was in my overdraft, and the charges kept taking me over my limit, i was putting funds in but them kept hitting me with charges.

    Eventually they took me to court, lodged what I remember is a court order against me prohibiting me having a bank account, closed the account........

    Is it too late to take action against them or not

    I opened an account with the woolwich before the action was taken, so Im able to bank and function but it is stopping me getting credit etc...

  • Just got the acknowledgement from both MCOL and A&L that they intend to defend the case.

    Not worried it just buys them an extra 28 days.

    Remember the onus is on A&L to justify the fines imposed on their customers.
    No bank has done that yet. Why? Because they know such heavy fines are not defendable.

    Stick in there guys ;)
  • I've MCOL'd A&L credit card, they were served on 18th April, the only response I had from them arrived today, a letter saying A&L (MBNA) disagrees with the OFT's interpretation of the law, and they maintain that their charges have always been fair, legal and transparent. (Yeah well, if that's true, why did they lower their charges from £25 to £12 last year!)

    They owe me £256.54 in charges. They have 'arranged for a goodwill payment of £26.00' to be credited to my account on the basis that this is 'in full and final settlement' of my complaint!!

    A couple of the other banks, cards (I'm doing 5 accounts in total) have either sent me a cheque or offered an amount, all significantly lower than the amount I'm asking for, which was straightforward enough. I either returned the cheque, or wrote to say I would not accept the lower amount, and confirmed that I still intend to pursue for the full amount.

    What can I do if they actually credit my account with the £26, do I have to amend my claim with MCOL? If so, that's a pain isn't it, since I understand that involves more form-filling.

    Any thoughts, suggestions, ideas welcomed.

    Oh. So it is not just me.

    Alliance & Leicester appear to really suck.

    I have had a claim in since 26th February and just had a letter refusing to pay.

    I am sure this has been answere here before, but it would take me a week to read through all previous responses (v slow connection!)

    I have had my statements from A & L (recieved on exactly the 40th day), replied to them saying, this is what i feel you have overcharged me, please look into this an refund me, and they have replied back saying that they feel their charges are fair and reasonable and regret to inform me that they will not be refunding me.

    Presumably this is just a "fobbing off" letter and I can now go on to the MCOL process?
