    sorry don't think i explained my concern v.well, i know they can't touch our mortgage!! i was trying to say that i'm hoping that because we've got our mortgage with them that they won't close (or threaten to) our account.

    A number of things could happen next ... you may or may not get their full defence (6 pages in total). If you've claimed on MOL and they don't defend in time, you can apply for judgement by default on the MOL website. Some people have had an offer of a partial payment and the defence in the same post! You may even get a cheque/payment for the full amount, especially as it's a relatively small amount. You'll just have to wait and see I'm afraid.

    It seems to be par for the course for A&L to close accounts when they pay up. Have you not opened another bank account yet? If not, I'd do so quickly, just in case. You can take them to court for closing your bank account as well, which some people have done .... I gather that this is also unlawful.

    There are no "guarantees" of what the banks will do ... there are many variations, all meant to keep us on our toes!

    Hi, Can Anyone Help Me Am Bit Confused Regarding Dates, My Claim Was Acknoledged 17th April But I Made My Claim With Mcol On The 10th April, My Claim Has Now Been Defended By A&l And I Have Received My Defence Pack From Their Solicitors, Do I Count The 28 Days From The 10th Or The 17th, What Date Is My Deadline Is It 8th May(tomorrow) Or 15th May, Thank You If Anyone Can Help Please, Thanks,

    See post 13 in the above link for timescales. The dates don't matter now as you've already received the defence within the timescales as far as I can see and, once the defence has been received and is registered on MCOL, the process online stops and it's all done by post.

    You'll find the guide to the AQ form in the Reclaim Help Thread which is linked in my signature.

    Please remember to put "without prejudice" in your letter that you send saying you will accept their offer in part payment but will be continuing to court for the rest of your claim.

    ps to nappy, can you knock off the caps lock as the forum is automatically doing it for you now and this is what causes the first letter of each word to be a capital, its makes for difficult reading.

    so does this mean that i will get a date for court and have to go, thanks for your response, it helps me a lot

    thanks for that - again!!! we've both still got our own individual accounts open so we could use one of them if it comes to it. it's just the £1200 overdraft i'm worried about :-(

    Claiming £913 from A & L
    Wrote 3 letters claiming money back, got usual replies
    Issued court case via web site
    Got letter from A & L giving me £104 cheque as compensation which i sent back saying 'get lost' (In a way)
    They have now got there own solicitor to take the case up and have issued a defence.
    I can no longer respond through the courts via the web as its now being dealt with at my local court.

    Now what????? any one else got similar responce? what do you think will happen next? could do with some help now.........

    Hi, i'm new.

    I love this website and visit it everyday, so thanks Martin! :money:

    I've recently started to claim all my bank and credit card charges from various companies:

    alliance and leicester £1200
    Marbles £170
    Capitol one £250
    Virgin £75
    HSBC £80

    My biggest amount is with the A&L £1200 (inc interest)

    Took them 40 days to get my statements to me.
    Sent first letter and got a reply as i've seen you all have had saying i was talking rubbish!! :rolleyes:
    So i've just sent my 2nd letter....:D

    Alot of friends have had money back within 14 days from other banks (Halifax) but i dont think it's going to be that easy from what i've been reading :mad:

    For people who've been sucessful how long has this process taken in total??

    I presume i'll be following the rest of you and taking it to Money Claim :T

    So i'll contiune to post and let you know how it goes.....

    RESPONSE TO THUNNISETT

    Thunnisett ... Look through last 5 pages, were all at same stage with Wragge & A&L ... Make sure you have responded to defence's paragraph 10 of defence (particulise claim i.e. send your spreadsheet to solicitors and court, oh and A&L) preferably by signed for post. My guess is it will go to court, and provided that you present a good case (see CAG court bundle) and your paperwork is correct i.e. providing all answers to defendants claims then I think they will not turn up, and as a consequence, you will maybe win.

    Some websites suggest you send a letter offering a settlement of just under what you are asking for .... it may 'look good in court' according to these sites.... Who knows?

    Think we will all be in Northampton soon, probably on our own. Some websites are suggesting that the high street banks are wasting the courts time, and there is a way of getting the court to get the defences case struck off (see penaultycharges website as an example)
