    No they are not claimable as this is a service charge and the bank will have checked your charges list against what they have charged you.

    after rechecking my 6 years of statements and ommiting the 'monthly od charge' charges, the chq that i recieved this morning would appear to be correct.

    however, i dont understand how one month i can have a 'monthly od charge' of £5 (+interest), and the next month i can be charged £25 (+ interest).

    is this standard practice from these muppets and in no way refundable?

    You said in a previous post these charges started after you changed to a Premium Direct Account which means those charges are a monthly service charge which you can't claim.

    If the charges are a charge for going over your overdraft then they can be claimed and presumably those will be for the days in the month that you went over your limits and possibly have a ceiling of so many per month.

    Please call your bank and ask what the abbreviations are in relation to your charges.

    after studying my statements some more, it appears that i get a £5 monthly overdraft charge if i dont exceed my £200 overdraft. if i do exceed my overdraft, then the monthly overdraft charge becomes £25. therefore, would u think im entitled to claim £20 back?

    ive also noticed that A&L seem to have 2 ways of charging, the first way as described above, the second way is to charge a low mothly od charge (£5, £8 or £10) and then a further 'unauthorised daily od charge'. there seems to be no set structure that they stick to which makes it difficult to determine how much of the 'monthly od charge' is the fee for service and how much is a reclaimable charge.


    please ignore my earlier post when i said this has only happened since changing my account to a premier direct version, as this has been happening since early 2002.

    any advice on what i should do? as said b4, ive got a chq for £1200 off them so im gonna bank that, i just feel its a few hundred short of what it should be.

    Sounds like it and can I just say paying £5 a month to have a £200 overdraft seems like an awful lot of money, cancel this Premium Account when you can!

    Your decision I'm afraid but why not try a letter to the bank saying you will accept in part payment but will persue for the rest and see if you get a better offer?

    i was thinking that too. maybe write to them and ask if they will provide a schedule of charges for the amount they have come to (so i can compare it to mine), and to try and explain to me how there od charges work!

    one more thing, what should i do about my MCOL claim? the 28 days were up on the 1st, and now the claim has 'defence' status. do i need to inform MCOL that ive recieved partial settlement? have i got time to correspond with A&L a few more times before a court date is set?

    would this letter suffice?

    'Thank you for your cheque for the sum of £1198.43 in settlement for my claim against bank charges placed on my account since 29th January 2001.

    Before I inform the County Court that this case has been settled in full, I would like to understand how our total amount of charges differ so much, with you calculating charges of £794, where I calculate £1173. I appreciate that in my original claim, I claimed refund for each ‘monthly od charge’ but now realise that this is a charge for service and would not be refundable. However, I fail to understand how there can be such a variation in these charges. For example, please could you explain how you calculate the variation in the following statement entries:

    21/12/2001 MONTHLY OD CHARGE £10
    21/01/2002 MONTHLY OD CHARGE £8
    21/02/2002 MONTHLY OD CHARGE £25

    From studying my statements it would appear (in some instances) that if I didn’t exceed my £200 overdraft limit I received a monthly £5 charge just for the privilege of having an overdraft facility. On the occasions I did exceed my overdraft limit, the ‘monthly od charge’ rose to £25. This appears to me that you were charging me an extra £20 each time I exceeded my limit.

    In order for me to believe that you are not short changing me of a few hundred pound from my original claim, I would appreciate it if you could forward me a schedule of the charges you have refunded so far in the cheque I received on 01/03/2007, so I can compare it with the list of charges that I have raised against my account. If I am happy with this, I will inform the County Court that the case has been settled. However, if I believe there are still charges to be refunded, I will inform the County Court of a partial settlement and persue the remaining amount through the Court.

    Ok, I have no idea what they are talking about now, They made me an offer which I'm not accepting as it 1/3 of the total charges.

    Today I get this letter!

Please indicate on the form the account (or accounts) that you hold for which you require the information. If you hold accounts that you do not require the information, please do not include these on the form.

    If you would like more comprehensive details on our entry in the Data Protection Register then you can apply to the Office of the Infromation Commissioner, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, (or telephone 01625 545700) for a copy.

    What to do.

    Please complete both sides of the Subject Access Request form and return it to me, with payment of £10. to the address shown on the bottom of the form.

    I haven't requested any information other than my statements that I paid for and received at the end of January.

    Any ideas what is going on?

    i have just requested the data and wonder how they'll respond when i ask for a refund of the charges.

    Well I've just started a small claim against A&L yesterday and i'm bricking it now. I refuse to let them get away with the charges they've imposed, but its still a little scary to think i've taken a bank to court, eek!!!
    The other people that've been given full or partial refunds, have you had to start legal proceedings to get to that point??

  • Came home Friday night to find a cheque from A&L for £593, £100 more than my claim! Then went on line to check bank balance. They have delayed depositing my pay until the day after all my monthly direct debits were due. They have rejected all my direct debits except one; this one was enough to exceed my overdraft. They have now charged me for eight failed direct debits and two unauthorised overdraft charges; a total of £322 in just one day!!

    I immediately rang them to complain and was told that my pay "must have been delayed in the BACS system, terribly unfortunate but there's nothing we can do." I informed them that I would simply take them to court again to reclaim the money. They claimed that my account would be closed before that happened so I wouldn't be able to proceed with any further claims against them. Lying B@$+@rds!
