    no, dont wait the 14 days. if they replied, then fire off the next letter. i didnt put the name of any court in my letter, i just worded it as 'the county court'.
    include interest in total amount.

    and ive claimed through MCOL btw

    do i just ignore this letter and continue with the claim or do i have to acknowledge it somehow? does the fact they say 'theyve made arrangements to pay me back £50.77' alter the amount of my claim in anyway?

    Well Fill, I am on the same schedule has you, and they have about 2 weeks left on mine, on the 7/2 i checked my online banking and they have refunded me £34, but i havent recieved any letter, other than the intend to defend on 1/2. I have checked other threads and they have paid up, and their claims have been filed after ours! Perhaps they are changing their tactics... My claim is for over 5K. I would ignore it and continue with the claim, has it come from their solicitors?

    the list of the charges, should this be a breakdown of each individual charge stating what they are for i.e unpaid item or is the MSE calculator print off still ok?

    mse printoff fine. it lists em individually anyhow dont it? no need for each to have a description of what it was for.
  • Sorry but yes the banks are quite likely to come back and ask for a description of each individual charge.

    edited to add, yes there are templates for with or without the 8% interest.

    i knew the first letter including interest wasn't at the top of these pages and i couldn't remember where i'd found it to look for the 2nd letter with interest.

    for anyone else who is as blind as me they are on martins article just below the calculator
  • It seems a lot of people plan to take A&L to court but has anyone done and got money out of them?

    If so, did they pay up before court?

    It seems that everyone gets paid up before an actual court apperance. I have been on a couple of sites.

    A&L seem to send an acknowledgement, that they are going to defend the claim, they then have 28 days to put the defence in. They send the cheque for the full amount to you before the 28 days are up. Normally it seems on a Saturday! (They must get all the paying done on a Friday)

    This is according to the other posts I have read. I am going to start my court claim on this Thursday 15.02.07 Will keep you posted as to the steps that they take. I am claiming £4500 including interest (Well interest upto know, I will have to redo the claim for the court, so it is upto date)

    i havent checked my online banking recently so i dont know if theyve actually credited the 50.77 to my account.

    you say uve recieved a letter saying they are going to claim, do you mean uve recieved the 'acknowledgement of service' letter which has the ' i intend to defend all of this claim' box ticked? ive recieved this letter, but theres no mention of a court date or anything on it? have u had a seperate letter with a court date & time on it then?

    this last letter informing me of my 50.77 refund wasnt from their solicitor, just standard letter from bank. have you gone through MCOL?

    I just had the standard reply from their solicitor, ticking the intend to defend box, sent with the acknowledgement on the 31/1, but not heard a thing since. No defence and mcol just states start, and claim acknowledged. Its just that people who have claimed before us have been paid out, and then this refund of £34, makes me wonder. It may just be a case of waiting a while longer.
    When did you file your claim? Yes I went through mcol, I havent sent the solicitors a copy of my schedule, but they have had two copies with the first two letters I sent.
