  • No need to worry about that, just carry on with your reclaim.

It looks to me, by trawling through as many posts as possible that A&L have a couple of stock letters that they send. They sent me the Guide to bank charges one and sent you the OFT one.

It seems to me it is all a tactic to make you cave. I am going to file court proceedings on 15th.

Keep at it - it's your money after all
  • I sent A&L the 2 letters following my bank statements saying I want my money back. The first one was a flat out "no" so I sent the one threatening them with court action.

I've just had a letter back from Alliance & Leicester stating the following:

"The Office of Fair Trading has commented that they consider the level of late payment charges to be unfair, however, they were actually referring to late payment fees for credit card payments, which are quite distinct from a banks charges on current accounts."

And then it goes on to say they won't give me my money back. So I guess I have to take them to court now.....or are they right????:confused:
  • Does anyone have the telephone number for the A & L Current Account dept as I would like to ring them and make sure that my SAR has been received.

My account is now closed so I am struggling to find the number

    Thanks

  • I got a fob-off letter today Stage 3. they are getting better within 7days.

    here what they've said.

    Charges raised against your account.

You contacted us recently regarding charges made to your account.

I have now had an opertunity to reveiw why the charges were raised and also considered your comments. I can comfirm that the charges have been applied correctly inline with the terms and conditions of your account, as such, I regret I am unable to agree a refund on this occasion.

    Guide to Bank Charges.

I appreciate you may be disappointed with this decision, but please be assured our charges are in line with those of other financial organisations. you can ensure no charges are incurred by arranging for sufficient funds to be in your account, ahead of any payments being made. On the reverse of your statement*, you will find details of cheque and cash deposit clearance times which you may find helpful when planning payment.

Our automated 24 hour Telephone Banking service is a convenient way to check your balance when making transfers or paying bills - just call the telephone number at the top of this letter to use this facility.

Alternatively you may wish to use our online banking facilities at https://www.alliance-leicester.co.uk, where you can easily move more money ahead of any payments becoming due; if you are not already a user of this service you can register by visiting our website and following the instructions.

You have received a standard reply from the bank. They say the charges are in line with their terms, but if the terms are not in line with the law, these charges are unlawful (which they are). Just carry on to the next stage. Your chances of a full refund are excellent if you stick to your claim.

    hi all.

ive filed my claim with MCOL for £1600ish against A&L. A&L have acknowledged this claim and have 28 days to defend or pay up.they still have approx 2 weeks of this 28 days left.

    however....

today i recieved a letter from them saying:

i have had an opportunity to review the situation and would like to confirm that the charges were raised correctly. however, i have taken your situation into consideration and as a gesture of goodwill i have made arrangements to refund £50.77 in respect of the charges raised. i would highlight that all future charges raised correctly on your account will stand.

£50.77!! :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl:

    the cheeky ghets!!!

do i just ignore this letter and continue with the claim or do i have to acknowledge it somehow? does the fact they say 'theyve made arrangements to pay me back £50.77' alter the amount of my claim in anyway?

    thanks in advance....

    Hi all

Have just received a reply to my first letter which i included interest on the charges.....it was the usual response by the looks of....NO:eek: (consistant if nothing else :p

A couple of questions before sending the LBA....

do i have to wait til the 14 days are up or can just send LBA now seeing as though it was not a satisfactory response

the total amount, should this be including the interest? or is there a template for the LBA which includes interest?

and even if i put our local county court in the letter can i still go through MCOL or do i have to put MCOL in the letter?

    many thanks
    nel
