    Brilliant! Thanks Rex_Mundi! Have had numerous conversations with them re it being their mistake, but they refuse to acknowledge it, so looks like I'm off to the Bank Action Group to download those sample letters again!

    Sample letters are all here and more in Martin's article.

    I'd also say that this is a good example of why its best to deal with the banks in writing and not over the phone. (unless they are offering a really good deal!)

    Edited to add, if you are phoning your bank about anything, have Martin's article to hand along with the letters and any information that might cover your complaint. Just this week a bank told someone that they had 40 days to send a "SAR pack" for signing then a further 40 days after it had been signed and returned, this is tosh as well but it helps if you have the correct information to quote.

  • This is my first time on the forum. I was on reading messages before Christmas and was encouraged by the amount of success stories as regards getting back bank charges. Until today that is! I read a thread about the Alliance & Leicester and there seem to be very few success stories and most of these people are only claiming at the most a few hundred pounds.

    My husband and I are with the A&L. We sent the letter to A&L using the template to get a list of the charges incurred. They returned this list well within the 40 days. But now, having gone through the list and calculated how much we have been charged, I'm scared that we're going to be laughed at. We have amassed about 3 and a half grand's worth of charges and that's only since 2002!!

    Is it worth our while asking for the charges back? I have to admit I feel rather scared.

    just thought id give an update on my A&L claim. (£1500)

    sent the 2 letters off mid jan, both times got relpies telling me the charges are correct. filed my claim on MCOL on 26/01. it was acknowledged on 01/02/07. confirmation of this 'acknowledgement of service' was sent through the post to me. on this receipt they have ticked the box 'i intend to defend all of this claim' and its signed by A&L solicitor.

    can anyone else who has made a succesful claim confirm that this is pretty standard procedure? it reads that they have 28 days to prepare their defence? so i take it they are gonna defend my claim?

    also, it appears that northampton county court has been allocated this case, which is certainly not local to me. can this be changed?

    It's standard for the banks to acknowledge the claim. This gives them an extra 14 days to submit a defence if they are going to.

    You will not have your case heard in Nottingham. All MCOL claims start there (this is where they are based). If the bank enters a defence, your case will be transfered to your local county court for the next stages and the remainder of your claim.

    I'm just about to send my second letter to the Alliance & Leicester claiming £430. Hope I'm as successful as most of you! Has anyone used the Northern Ireland Small Claims Court to do this? Does it make any difference?

  • I have put in my claim to Alliance & Leicester at the court personally because I claim incapacity benefit, and I claimed low income so I was liucky I don't have to pay the court fees. The court posted a summons to them, they have replied and they say that they are appealing against the claim. I am a bit worried as to what to do next. Say they do decide to take it to court what will I have to do? please help!
