  • just wanted to say thanks to martin. this is dead straightforward, just follow his guide to reclaiming BY THE LETTER and you cannot go wrong. I filed a claim on moneyclaim (county court) on th26th jan and today received a letter from alliance and leicester's solicitors saying that essentially they dont owe me a bean BUT they have paid IN FULL as its not worth going to court! :j :T :T :T :T :T :T :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :T :T :T :T

    Hello there,

I wonder if someone could help me out. I've previously successfully reclaimed approx £600 from HSBC in bank charges, and have now (voluntarily) moved my account to Alliance & Leicester.

Over the past few days, they have charged me close to £100 in bank charges (2 x returned dds and 1 o/d charge = £34 x 2, + £25 = £93.00) and unfortunately mostly cos of their own error! Grrrr....

Obv not very happy with that, so when I phoned today to ask them to give me the money back, the person on the other end of the phone said there'd been a new ruling that the 'reclaiming unfair charges' rule only applied to credit card charges.....

I haven't heard about this beofre, and was v surprised - can anyone shed any light?

    Thanks lots

Absolute tosh!!! This is not true at all. You can do the same process as you did before to reclaim these charges, although you mention you got these because of a mistake by the bank. If they made a mistake that ended up costing you money, it may be worth using the banks complaints procedure to get these charges back. Their mistakes should not end up costing you money.

  • I closed my A&L account over 3 years ago but I know in the 3 years prev they charged me quite heftily. I cannot find anything with a/c number on so rang them today to see what to do. They said they have 40 days in whick to send me a pack that I need to fill in and then once I return it they have another 40 days to send me the statements.

So 80 days before I get my statements at least. Is this right do you know?

    Thanks
  • No, they have 40 days to provide the information full stop. I would write back to them and tell them if they don't provide it within the 40 days you will report them to the ICO.

edited to add I see you rang them, ring them back and quote the template letter at them
  • Ok thanks I will ring them again on Monday and see what they say.
  • Hi,

I'm posting on behalf of a friend for whom I am trying to recover A&L bank charges on his current account (£1000).

I have set the first letter asking for the refund and received the "Sorry, we're not going along with it!" message. I was due to send the second letter to them today to tell them we are going to court but my friend received a letter this morning from a debt collection agency they have passed the debt onto as they claim he defaulted on his repayments (this current account is overdrawn by a few hundred pounds due to them debiting all their nasty charges).

My question is - do we need to contact the debt collection agency? If so should we tell them about the impending court action? Also, should we send the last chance to settle before court letter or lodge the claim without sending the 2nd letter? The debt collectors have given my friend 7 days to pay in full (about 300 pounds) which he can't do. Should he try to re-negotiate a repayment plan as he had before he defaulted? We do not want debt collectors at our door!

    Thanks very much.
  • If you can't pay the £300 I would get in touch with the debt collection company and offer to pay say £5 a week to keep them at bay and carry on with your claim as a good result for your claim will mean you can then pay off the debt.

Don't go straight to court without sending the appropriate letters to the bank and make sure the debt is paid off as soon as possible.
  • please can you help, A&L have charged me £50 for two DD's they say I did not have the funds to cover. Even though I transfered the money to cover the DD's into my account before 9am on the day they were due, A&L say I did not transfer the money early enough in the day and that I should make the funds avaliable the day before the DD's are due. Can this be right? Do I have a chance of getting my money back.
  • Does anyone know if u can claim the daily overdraft charges with A&L?
