thanks to both repliers.
I can`t find anything in t&c - first I knew about it was when a notification of charge appeared on a statement.
I used the travel insurance once but they have now reduced cover from world-wide to European only, which makes it less worthwhile0 -
Success!!! They have written a cheque for £80 for my mother's account. (£50 + £30 charges) I did warn them twice but they told me to go ahead but in the end they have written the cheque so who cares!!!If i have helped, use the thanks button!0

I have messed up/mistimed a standing order and as a result, have been charged £25 (letter sent to me) plus £25 overdraft fee still to be added according to online banking for going overdrawn by £99 for 3 days  . Busy kicking myself as the standing order is from A&L to ... A&L for the Direct Saver and only ended up within insufficient funds because I paid back my stooze from credit card early. Currently very annoyed with myself  as I am fortunate in having funds available in other accounts, plus more with A&L, and could have left an extra £100 in without a problem.
Anyway, does the fact it is my fault alter the fact that £50 for 3 days overdraft of £99 seems excessive?
Many thanks

As a result of an enquiry to customer services, A&L offered £25 as a gesture of goodwill - has anyone managed to get them to pay a larger proportion of the fees back please? I know it was my fault, but £25 still seems alot for £99 for 3 days.
Many thanks

I read in the paper that banks like A&L close poepel's accounts after they make a successful reclaim of what they think to be unfair charges.0
-
All banks can and some do close accounts or call in an overdraft and this is why Martin suggests you set up a "parachute" account when you start this process.0
-
I started the process by requesting my 6 years statements from A & L in Dec 2006. They cashed my £10 cheque on the 20th Dec and I hadnt received anything up to today so rang and asked. The girl told me that they generally take the full 40 days allowed to get this done. I think they like to play hardball but as I think I am looking at about £3k over the last 6 years I am going to play harder.0

Dear All,
i would like to add my two penny worth here if you dont mind. If you think that the bank has taken money from you in charges, late payment fees non payment of direcrt debits etc. CLAIM IT BACK. They will mess you around. How many people do you think they are reiceiving Data Protection letters from a day. I would say thousands and they probably finding it hard to keep up. This bank charges has become the rolling stone gathering up moss. If you understand my meaning.
Time and time again the banks can not prove that the bank charges they are charging are a fair estimate of what it costs them to send out this computer generated letters, computer generated charges etc. #what does it cost to send a letter. Don't forget they send out thousands of these a day getting a discounted rate on postage because they use frankiong machines. Huge discounts on paper and envelopes. #They say that their charges are based on what it costs per customer. How can that be. They have millions of customers and spred the cost across all those customers in charges, interest charges etc.
If you owed them the money they take it with out asking you because it is in their T & C's.
A couple of laws here for you
Under the Sale of Goods Act the cost of the service is requird to be reasonable. S.15 says that where no price is agreed at the time the contract is made up then a reasonable price will be implied. ( The contract is already made up, you just sign it because you need the account)
The banks say the contract is fair: They are disproportionate fees levied on your account./ This is covered under ___The Unfair Terms in Consumer Contracts Regulations 1999 Schedule 2(E) ___requiring any consumer who fails his obligation to pay a disproportionately high sum in compensation. This unfair.
They say they are covering their loses. I do not believe that the charges levied for breach of contract reflect any actual or real loss on the banks. There are case histories to prove this.
Alliance and ;Leicester as with other banks are loathe to do a breakdown of the charges they levy on customers accounts in front of a judge because they know that they can't.
With Alliance and Leicester they normally settle if you have to take them to court within the 28 days that they have to defend. 99.9%
They will close your account down I believe, mine was already closed so I was OK.
I hope that this helps to further all your resolves to take back control of your life and stop letting people push youu about.
It is very stress relieving knowing you no longer have to worry as much and gives you a chance to get your finances back in order and get your life on an even keel again with you in the driving seat.
I hope that this has helped. If they owe you money GET IT BACK0 -
I have served the Alliance and Leicester with court papers. I am on incapacity benefit and am claiming over £2,000 back but it should have been more, I couldnt afford to do it with money claim but di it myself I filled in the paper work and applied for low income, I was granted it and have had nothing to pay out it was sent to them on 15/01/2007 and now I am awaiting for their reply as to wheither they will go to court or pay up before, fingers crossed jane thomas:rolleyes:0

I have sent my second letter threatening to take A&L to court, they have replied saying they are looking in to the matter and will get back to me ASAP. Do I have to wait until they get back to me before I start the court proceedings? As the letter I sent does say I will commence court proceedings if I don't get a response. Or should I just go ahead and file the claim as the response wasn't satisfactory?Debt Arrangement Scheme - started 1 December 2008 at £34200. Now £30442, 81 months to go!0
