    I sent my second letter and got another letter basically telling me to bog off that the charges are correct

    Do I have to wait until they get back to me before I start the court proceedings? As the letter I sent does say I will commence court proceedings if I don't get a response. Or should I just go ahead and file the claim as the response wasn't satisfactory?

    You start the court proceedings on the date of your expiry deadline. Don't wait for them to respond.

    But they have actually responded, albeit not saying very much. So does this not count as a response as such and I can just carry on?

    Your letter should say, you will start proceedings after a set period of time, usually 14 or 7 days if you haven't received a refund. If you haven't used the letter templates then you risk the procedure taking longer or going wrong.

    If you haven't specified a time period, then you can either write to them again, this time specifying a date when you will start proceedings as a response to their letter. Alternatively, you can wait for the bank to 'look into the matter', which could be anywhere from a few days to never.

    Yep, I did use the template, but it states "I look forward for a full response to this letter within seven days, otherwise I will commence court proceedings to reclaim my money". I suppose I haven't received a 'full' response, so I'll start proceedings on Friday, which is seven days after they received the letter, if I don't hear anything else.

  • Hi guys,
    I'm in the middle of claiming my charges back from alliance and leicester. So far i`ve had all my statements sent to me, and worked out that charges total £648.
    I've sent the bank a letter, using the template from this site, and with a full list of the charges attached, and have just received my reply from them claiming that they have reviewed my case, and have found that all charges where lawful and correct, and they shall not be issuing a refund in this case, also it would be beneficial to me if i were to ensure that sufficient funds where in my account at the end of each month to make sure that i dont incure charges! Ok, so the next step if threatening court action, but i`m slightly worried about this, as the charges of £25 a time for unauthorised overdrafts have usually been because i`ve gone over my overdraft by more that £25, so i was worried that they would have a decent case against me. Please could anyone tell me if it matters if the charges are less than the amount overdrawn? This is my biggest worry.

  • This is just a standard letter from A&L, just carry on with the next step and you'll be okay.

    Of course it would be beneficial to you to have the corrects funds in your account (and Martin does go through this at the start of his article) but what this fight is about is the amount that banks are charging you and nothing to do with the exact amount that you may go overdrawn :)
  • Hi, both my son and husband bank with the A&L, we claimed back charges on both accounts, success with my husbands account a full refund given. :j

    A different story with my son's account, they are claiming the charges have been applied correctly in line with the terms and conditions of the account. I then sent the next letter, stating I will commence court proceedings to reclaim my money. They are still claiming the charges are correct.

    Has anyone got this far?
    Is it going to cost to go to court? If so, do you know how much?
    The charges are almost £1,000 on my son’s account. He needs it back.
    Can anyone help or advise me please.

  • Hi all,

    Ive had a letter from the A&L stating they've made arrangements to refund £75 back to me as a gesture of goodwill. £50 of that was due to be debited on Sunday 28th Jan, but obviously isnt now. I have £75 worth of charges that have allready been applied at the begining of December. What do i do now???
    Should i write back and give them another 7 days or i'll take it to court? or call them and ask for it??

    Im chuffed at getting the above sorted but feel i need to get the rest back as a matter of principal.
