Yesterday in London the 30 cases against(different) banks were heard in court. According to the newspapers, the results were mixed, and depended very much on individual cases. The banks did turn up! Banks were critised for delaying tactics like those A&L uses . Not everyone got paid up so you really need to have as much evidence as possible before you go to court. None of these cases was recognised as a precedent so the field is still wide open. Good luck.

I just got my court date for october! Attached to the letter were some notes from QC Mackie - who was in charge of those cases in london.

I'm going to try and settle with wragge now - i don't really want to wait til october, although the interest would add up nicely!

What is on 12th July, your court date? Have you had the judge's directions yet? Is so, what do they say? You may not have to prepare the court bundle, but it depends on what you're asked for.

To all asking about the court bundle, there are links somewhere on this site and also in the court bundle thread somewhere, but admittedly they may not be easy to find!

The bundle is basically all the legal papers (OFT report, etc.) and settled cases which will back up your Statement of Evidence and/or Witness Statement ... it depends on what your individual judge asks you for. The link to the "basic" court bundle to print out is here :-

    http://www.consumeractiongroup.co.uk/forum/guidance-notes/64911-got-court-date-guide.html#post553523

Bear in mind this is the "basic" bundle ... you'll have to source other info. yourselves according to what you think is appropriate to your claim, but you'll get lots of useful advise if you sign up on the CAG forum.

The link to other documents/statements you may be asked for is here :-

Don't worry about the court bundle until you get a court date and directions from the judge, just keep all your correspondence between all parties in date order and sort out your highlighted statements (only the ones with charges on). This usually has to be submitted with the bundle. You may not have to produce the bundle (many are not now) ... depends on the judge.

    Hi all

Hope you are all well. I have received a letter from my local court today and any advise would be great.

    Basically it says:

Upon the courts own motion. The court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.

    IT IS ORDERED THAT

    1. The defendant do serve on the claimant and send to the court full details of any facts and matters relied upon to show that each and every item of charging detailed by the claimant is reasonable and proportionate by 29 June 2007.

    2. This case be referred back to the District Judge after the twenty first day after service of this order on the claimant.

Well I don't want it stayed or anything. Am I right in thinking that this means the judge wants A&L to show how it actually costs them for these charges. (they will never disclose this?) also that if they don't disclose them I will win???.

There is no court date set so this looks to me as if I won't have to go, do you think this is the case?

Thank you for all your help in advance

Looks good to me! Doubt if they'll reply as I don't think any bank's disclosed how they've arrived at their exhorbitant costs! Looks like you don't have to submit anything yourself and there won't be a court hearing.

Yes, it could well be judgement by default if they submit nothing ... you're in a very good position now!
