    Hi all,

    i started the reclaim process on behalf of my mum with A & L in April this year we have been going back and forth since then in attempt to reclaim £2000 not including interest they offered us £1142.50 last month which we gracefully declined without prejudice as a full and final settlement stating that we were negotiable but not to that extent. We have received a reply today saying that as far as they are now concerned the matter is now closed they will not be revising the offer and we should contact the Ombudsman if we want to take it further. So my question is in light of recent events in Hull and so forth should we proceed with court action or refer the matter to the Ombudsman or do you think we should just accept that offer? we really could do with around £1500. My folks are short on cash at the mo and can't really afford the court costs up front...

    any advice and sensible suggestions will be gratefully received... :)

    Entirely up to you whether you accept it or not ... only you/your mum can decide whether you need the lesser amount now, or go for the full amount (which I'm sure you'll get in timeicon7.gif).

    I would think that, if you refer the matter to the Ombudsman, it might take longer (he's probably inundated!), so you might be best to start court proceedings yourself, if you decide you want to continue.

    As regards Hull, people are generally being advised not to be too alarmed by this and, if you look at the success thread, banks are still paying out thousands daily. This is the view of one court/judge I believe ... the vast majority seem to be more in favour of the claimant.

    How come i have the bad luck to get a date in OCtober? I'm not even sure i have to do the bundle - as all the judge has asked for is a

    'witness statement stating schedule of charges, dates and the extent to which they are disputed and for what reason'

    is this normal?

    Hi eyeball ... sorry to hear you have to wait 'til October, what a painrolleyes.gif At least by then you'll have a good idea from others how A&L/Wragge intend to play it.

    Each judge is asking for what they consider to be the appropriate directions, i.e. there's no "normal". You're probably aware, but the CAG site have templates for Witness Statements here :-

    It does look as if you're not required to produce a bundle (lucky youicon7.gif). This seems to be happening more and more as the judges I think see it as a waste of the claimants' time (and they must be sick of seeing itrolleyes.gif).

    Bank : Alliance & Leicester Plc
    Claimed : £2,845 (+change)
    They paid : All of it! (just waiting for cheque from court)

    Used up all of the pro-forma letters on the website and eventually had to go through MCOL. However they did not acknowledge the claim in time (one day too late:rotfl: ) and I had a warrant issued.

    Court says I should have the money in my account by end of June which means the entire process from start to finish took about 4 months. Well worth the wait!

    Many thanks for all the tips Martin, same goes for all of you helpful folk on the forums too!

    Cheers for that link, Mimi. Am glad that they aren't wanting a court bundle - but i may try and enter into negotiation with wragge - see if they are willing to settle early.

    A&L owed me about £110. They just sent a letter offering £52.50.

    I'll accept it ... can't be bothered with the hassle for another £50.
