Standard practice.
However, intending to defend and actually filing a defence are two different things.
If they do file a defence, the claim will be transferred from Northampton (where Money Claim Online are located) to your local county court and a date set for the hearing.
If they don't file a defence and when the deadline expires, you can apply for a judgement by default on the Money Claim Online website.

I'll let you know
I'm ahead of you, they defended and it has now been moved to my local court. I have just recieved the "Allocation questionnaire" which needs to be returned to the court by 2nd July along with a further £100. (Other people mey be exempt from this fee)
I am kind of expect that A+L will settle the case before we get to the 2nd July and are just playing a waiting game, waiting for me to give in! I have signed upto the Consumer Action Group website (links at the bottom of Martin’s article) where I found very useful information on how to fill out the form and how to prepare the Court Bundle later (40 pages of legal notes alone).
If they don't settle the case by 2nd July, they may settle before it gets to court (Barclays often do this), and if not by then, I will attend court and ask it to be struck out on the grounds that the defence is deliberately incorrect and the A+L are wasting mine and court's time by trying to defend this case.Got It & Spent It :dance:IKEA CARD = £120 charges = £175 received (146%)MARBLES = £450 charges = £370 received (82%)I.F. = £494 charges = £494 received (100%)CAPITAL ONE = £981 charges = £1,489.03 (152%)BARCLAYCARD = £580 charges = £786.12 (136%)On Hold :mad:A+L = £722 charges (target = 147%)BARCLAYS = £1,405 charges (target = 128%)BARCLAYS = £175 charges (target = 140%)ABBEY = £3,220 charges (target = 148%)0 -
Hi
any help would be appreciated. Alliance and Leicester have sent a solicitors letter defending my claim. they have also sent a separate letter offering settlement but for only half the amount I am requesting.
I do not want to accept the offer so can you tell me what the next step is please.
Slightly panicing now

Hi everyone,
I wrote a letter to MBNA/Alliance & Leicester, asking for my statements, on the 26th March. The letter asked for the last 6 years of statements. Suprisingly I recieved a letter back within the 30 days with the charges datailed. However, they only gave me charges dating back till 2003.
In the meantime the account was passed to a debt recovery company. I have just this moment got off the phone from calling the Alliance & Leicester credit card hotline. I was told that they didn't deal with the account and he continually tried to give me the number of the debt recovery agency. I explained the problem and even read the letter to him.....from Alliance & Leicester! I asked to speak to his supervisor and he told me I couldn't. He kept reading out the debt recovery number and then hung up!
As you can imagine I am fuming! Can anyone please help!?!0 -
hello,
Can any one give me any advice please
I started a court case with alliance leicester and a few days after recieved a cheque for 950, I was claiming 2500, so I worte back saying I accepted it as a partial payment and would carry on with the claim.
A week later I recieved a letter from wragge and co saying because I had banked the cheque I had settled because it was a full and final payment, and told me to inform the courts to cancel the case, so I wrote to wragge and co telling them that I would not cancel the court case, as I didnt take it as full and final payment.
Now today I recieved a letter from them saying if I dont cancel the court case they will make an application to get it struck out and seek the costs from me.
Its only that when I read the letter again that came with the cheque, it did say full and final payment if i accepted it.
Does anyone have any advice or have I messed up big timeJuly 08 GMTV Mazda MX5 :T& Belinni Basket Hamper, Mamma Mia Beach Bag, August 08 Rizzla Wallet, £25 Real People Mag x 2, Philadelphia Hammock, September 08 Schwarzkopf Gift Set, £45 Durex Lucky Bag, October 08 Bennets Superbike Championships Tickets JUNE 2011 2 x f shoot skill kits, 2 x cushelle teddies , crysis tshirt, JLS cd, JULY 2011 JLS Book0 -

Good luck with your claim but judging what has been offered to other claimants, you are quite lucky as most others get offered approximately 1/3 of their claim! Go for it.0
