    hi nappy
our you up in liverpool county court?
i havnt got my date yet,but i had to pay the £100 because my claims over £1500,just waiting for a date
    jono
    Hiya there,
Yes im up in LCCourt 19th july at midday.
I rang the court yesterday and spoke to the chamber and asked all the questions that i needed to ask, one being to I pay £100 unless ive missed something but they have told me "no" unless it has been asked for.
So now i am a little concerned and "paranoid", because i rang solictors a while ago making sure that they had received my "schedule of charges" to which they said that they hadnt, so am currently sending another set to them and to the court, so am wondering now why i havent been asked to pay£100. All the court has asked me for is a"schedule of charges, dates, etc", and nothing else, also whatever i send to the court i am to send to the solictors, also my letter stated, that it will take no longer than 10minutes, and that im in a block of about 6 or 7 other cases, so does this mean that the judge has already made his or her mind up.
Let me know when you get your date.
Have you completed an AQ, i wasnt sent one to complete.

    Hiya Napz,

Good luck for the 19th , are you all set , court bundle submitted etc.?
T&C's submitted with court bundle for period in dispute.
    Any witness evidence gathered etc.?

I've been told that my case has been passed for directions to the District Judge handling my case , so hopefully I'll get a date in the next 2 weeks , I'm sick of waiting , unless A&L pay up 90% of what they owe me , it's off to court.

Any help or advice you need plz just ask.

    Sixx. :j

PS: has anyone had further correspondence from wragge's over past few days , with an improved offer?
    Hi and thanks,
As stated in above message, all ihave been asked for is my list of charges, dates and amounts, nothing else.
I rang the court yesterday and they told me to send in what is asked of my on my letter, but if i wish to send in anything else i can, but whatever i send to the court i must send to solictors also, i have until the 21st June to complete, and send everything off,
Any advice is much appreciated, thanks,
I havent long been with the forum and i seem to be the onlyone who is in court so early, before everyone else i mean!!
Thanks again, been getting brilliant advice and guidance off mimi, what a star,
    any other advice please tell,
    Nappy x

    Hiya

I have filed my claim, in person, at Leicester County Court. I have been sent the defence papers stating all the rubbish it seems is in everyone elses.

I have been sent an AQ, which I have completed using the CAG website and here for guidance, However, I've read here several times that courts aren't using the AQ's anymore. Does anyone know if this means that my case is heading down the pan??

I have had one offer of a quarter of the amount I'm claiming from A&L but no offers from Wragge at all. I'm just starting to get an uneasy feeling about it.

If anyone can help me, please let me know. I'm starting to feel like its going to fall in around my ears.[/QUOTE

Leicester CC are still doing AQs so nothing unusual there really. Keep cool
  • Thank you for that Twinkly

Starting to feel a little worried , I am in the process of getting my bundle ready to deliver to court at the end of the week. Looking at others with prospective hearings of 10 mins and 20 mins, mine has been allocated up to one hour! what are we going to talk about for so 1 hour, especially if A&L dont show. My date is not till August 3 rd so hopefully by then we shall have a better feel for what will happen. Good luck to nappy and anyone else who is up before me:T :T :T :T

It depends on your local court as to whether an AQ will be requested or not ... each judge has his/her own ideas. They've been dispensed with in some cases as judges already know what claiming bank charges entails, how long a hearing's likely to last and that the bank are unlikely to turn up. Others like to have it all in writing from the claimant.rolleyes.gif

You're likely to get an offer in the early stages from A&L (as all of us have), but unlikely you'll get anything from Wragge (who are obviously acting on A&L's behalf when it reaches court stage).

It doesn't appear you've done anything wrong and there will be times when you hear nothing for what appears to be ages.

    Hi Guyz,

Well here's a turn up for the books , after some serious negotiation's with the A&L's solicitors , they have made me a very generous offer which i am going to accept.

I probably could have got a little more, but as it is so close to my 'Cut Off' figure that I had in mind I'm going to call it a day.

I'm off on holiday soon , so if i don't see you all before your cases start to get to court , good luck and give 'em hell.

Negotiation does work but you need to be willing to meet the bank on common ground , however i still believe that all you guys will get the full whack back , it's just more convenient for me to take the money and run :)

    Good luck to you all.

    Sixx :) :T
