    Hi all,

I got my notice of transfer to my local court last week. I gave the court a call to find out when I might get a hearing and whether they were doing allocation questionaires. Turns out they still are and that I won't get a court date for three to four months! Other than sending nudge letters is there anything I can do to speed things up? Did I read somewhere that you can ask the judge to direct the bank to reveal its true costs or be ruled against?

One more bit of adivce, I had the defense through from Wragg and Co on the 29th May and sent off the spreadsheet of charges to them by recorded delivery on the 1st June. As it's now ten days later and the item still hasn't been delivered, I am wondering if I should send a second copy to them by special delivery? Bloody royal mail!

    Thanks

I have received a prelimenary hearing date for the end of July, through the small claims tracking service!?!? it states that it will last 20 mins, i've not had to fill it an allocation questionnaire or anything, is anyone else at this stage?? do you know what happens next??

I've read of someone recently having a preliminary hearing on the CAG forum with A&L. It was a "block booking". Wragge did turn up, but the solicitor left a little red faced when the judge gave the claimant a couple of weeks to send in amendments and Wragge wanted a lot longer to preparerolleyes.gif. It all went absolutely fine.

If you know for definite Wragge haven't received your charges spreadsheet, yes, send them another by R/D just to cover yourself.icon7.gif

It's OK to send nudge letters, but opinions differ on whether they're a good idea or not. They can be seen to make you appear "desperate" but, on the other hand, if it did go to court (highly unlikely) the judge may look at this favourably as you've tried to settle. I'm sure A&L have never paid up when they've received one. Up to you ...

    Hi All,

Well after much faffing about and trying to come to a reasonable solution with the A&L via wragge's and leaving it till the 11th Hour for AQ submitting.

I didnt have to pay the £100 AQ fee tho , if your on income support or WFT credit , you use a ex160 form and submit this instead of the fee.

Make sure you have a up-to-date award letter and a copy of a recent bank statement highlighting your most recent payment.

I've had enuff of messing about with the bank.

Just going to wait for the court date now unless they come back with a decent offer.

Also arranging ex A&L employee to give evidence and exploring the possibility of bringing in other witness statements.

    Quick question for ya all.
In a UK civil case such as this , can a claimant order a witness to appear on the strength that they have vital evidence , even if they don't want to?
I think it is possible , gonna have to get some more advice on that one and get back to ya all.

No way im letting them get away with offering me , about 10% of what ive claimed.

    anyway......

Goodluck guys, who's up first now? any one actually got a firm date yet?

    Seyyaz,

    Sixx:eek:
    Hi,
Not sure if im first or not but my date is 19th july, panic panic, so wish me luck, you guys, any helpful info, please let me know, thanks,

  • Me v Alliance and Leicester

Got the defense through from Wragg&co but this has no instructions or letter with it apart from the standard 'this is A&L's defense.......

Do i have to do anything??

At the same time i had a letter from A&L with a cheque for £474 inc court fee of £120 in settlement of my claim! :rotfl: stating that if i accept my account will be safe.
I have written back (R/D) stating this is not good enough and i want the full £1450 please. I have offered to settle minue the interest and said that i will keep the cheque as part settlement or i will send it them back depending on their response.....

I'm getting sick of this now, all the other 4 banks/CC i've dealt with have given in a paid up...just Capital one and these guys who are !!!!!!s to get anything out of....

Hi again, i havent sent any nudge letters yet, would this be a good idea to sent one now and would it work in my favour when it goes to court, if the judge sees that i have attempted to settle with A&L before 19th july (my date for court), any suggestions would be grateful.
Do i need to get in touch with the court before my date as i havent done so far, i havent paid any other money as yet, i think i have read on other messages that people have had to pay £100! What would this be for or am i getting confused.
Do i now need to start downloading my "court bundle" NOW!!
SORRY for all the questions, but at the end of the day we are all here to help one another, so bring it on A&L, am quite looking forward to my day off work!!!

  • Hi, iv sent Alliance & Leicester my letter asking for all bank charges back and i received a response within 4 days time, although [/B][/B][/B][/B]they said that their bank charges are not unfair or unlawfull and that it was "credit card fee's" that were unlawfull and therefore they will not be refunding me any money!! They also said in my letter "i enclose a copy of our complaints leaflet which explains the steps we take if you are unhappy with any aspect of our response or call customer services" but there was no complaint leaflet of any kind AND when i called customer services they refused to speak to me and said anything i wanted to say would have to be done by letter!!! im v.annoyed i'm not dropping this coz i know there liars but what should i do from here? Please can anyone help! x[/B][/B][/B]
