Hi everyone
I received copy of defence from Wragg & Co on 30/05/07 but nothing since is this normal or what do I have to do to get it to the next stage - is there a time limit for them to contact the court or not.
Any advice would be greatly appreciated.

If the defence states you have not "particularised" your claim, send them your charges spreadsheet, stating you've already sent this to A&L and the court (if you haven't, do so now) and you hope this now clarifies your claim, then wait for a court hearing date and directions from the judge. This may take a few weeks ... it depends entirely on how busy your local court is.
You may wish to start preparing your court bundle now ... a good start is getting all your correspondence/highlighted statements in date order. A link to the basic court bundle containing many of the legal documents you'll need is here with some other useful info.:-

Hi all A&L have made an offer of £384.00 including the £120 court costs in settlement of a £1544.00 claim - don't think I'll be accepting this!!!!! Is there a standard letter I can use to decline this offer or do I have to pen one myself? If anyone has a letter I could use or can give me advise I'd really appriciate it as I'm so close to winning!!! :beer:
Ps I've already issued a court summons which they advised they would defend (funny way of doing it?!?!?).

Have had success with Alliance & Leicester today (well sort of!), I've asked for my bank charges back and had the standard "no we are not repaying you" letters so I sent the letter telling them I was going to take them to court but gave them the chance to pay a lesser amount (one of the template letters) and today I've received a letter agreeing to repay me! Had to sign and say that would now be the end of the matter and they have said they will pay the amount into my account as soon as they receive my letter. They also said they wouldn't close my account, but I've opened a new one anyway so I'm going to get my money and say bye bye A & L!
I know I would most likely have gotten all of it plus costs back had I have taken them to court, but I'm happy with what I've got, after all it is money I thought I had seen the back of, and finding the fee for court would have been a bit of a struggle.
Got another account with them with almost 2k in bank charges on, haven't had a response regarding that account, but I'm hoping they will do the same with that one too.
Good luck to everyone who is taking them to court, though I'm sure you won't need it!0 -

I rang Northampton today to try and get some idea on the timings - they said most paperwork is being transfered to local courts within 7 days - the defence was lodged with them on the 30th of May so should receive something either Saturday or Monday from my local court - fingers crossed.

Mimijane and jonaefc i have just received my court date for 19th july, it is asking me to
Claimant do within 21 days of the date of this order, serve a schedule setting out the amount of individual charges, the dates they were applied to the account and the reasons for such charges.
Allocation questionnaire dispensed with ( WHAT DOES THIS MEAN) i havent filled an AQ out i was never sent one!
so please help, what am i to do now!!
The date on my letter is dated 1st June, so am presuming 21 days from this date, is that correct.
My letter also says,
In order to utilise judicial time more effectively this matter has been listed with a number of similar cases, and will take no longer than 10minutes,
Will appreciate any help thank you,

Hi again, i havent sent any nudge letters yet, would this be a good idea to sent one now and would it work in my favour when it goes to court, if the judge sees that i have attempted to settle with A&L before 19th july (my date for court), any suggestions would be grateful.
Do i need to get in touch with the court before my date as i havent done so far, i havent paid any other money as yet, i think i have read on other messages that people have had to pay £100! What would this be for or am i getting confused.
Do i now need to start downloading my "court bundle" NOW!!
SORRY for all the questions, but at the end of the day we are all here to help one another, so bring it on A&L, am quite looking forward to my day off work!!!

nappy, I am in the same position as you, my date is Aug 3rd Yes you need to get your court bundle ready now and get a copy to the court and wragge &co befor the 21 days are up. The allocation questionaire dispention means you dont need to fill one in, or pay the £100 fee. I am assuming the 21 days runs from the date of the letter. Good luck, let us know how you get on, any more questions just post and I am sure one of us will be able to answer.

Hi - this is the first time I have been on to the forum part of the site and cant post my own message so I hope someone can advise me over my problem which is similar to the writer of the initial query. Over the past few months I have been pursuing the Alliance and Leicester for my charges. Usual standard letters received so on 21st May Issued a claim through the courts for £1683.09 (interested added). Yesterday Friday 8th June had a letter from a firm of solicitors advising me they are acting for A & L defending the claim.
This morning I have received a cheque for £429 (includes £120 court costs) from A & L. They say that this cheque is in full and final payment and they go on to say if I dont want to accept then return cheque to them. Finally saying I do not have a rasonable cause of action against them and I do not have a reasonable prospect of succeeding in any claim.
What I want to know is has anyone else had a letter like this and returned the cheque and continued with the court case and won.

Hi, you will find some template letters in the library, you can send them the one which states you accept the offer as 'part payment' without prejudice and you will be persuing the claim for the rest of the monies owed to you,

The 21 days is from the date the directions are considered, at the top of the paper.
By the way, you're not ahead of me ... my dates 1st August; Nappy is though.
