    This is what we ALL received initially ... it's just tactics to try and fob us offrolleyes.gif Every letter from A&L is "standard", including their Defence!

    Send them an LBA (letter before action) if you haven't already done so, threatening them with court action. You can start court proceedings 28 days after your first letter requesting your money back, but you must be prepared to go all the way ... A&L only pay up at the last minuterolleyes.gif

    Me v Alliance and Leicester

    Got the defense through from Wragg&co but this has no instructions or letter with it apart from the standard 'this is A&L's defense.......

    Do i have to do anything??

    At the same time i had a letter from A&L with a cheque for £474 inc court fee of £120 in settlement of my claim! :rotfl: stating that if i accept my account will be safe.
    I have written back (R/D) stating this is not good enough and i want the full £1450 please. I have offered to settle minue the interest and said that i will keep the cheque as part settlement or i will send it them back depending on their response.....

    I'm getting sick of this now, all the other 4 banks/CC i've dealt with have given in a paid up...just Capital one and these guys who are !!!!!!s to get anything out of....

    There won't be any instructions with their Defence. If it states that you haven't "particularised" your claim, send them your charges schedule, state you've already sent this to A&L and the court (if you haven't, then do so) and say you hope this clarifies your claim.icon7.gif

    Please can someone help me. I am going to the Money Claim online site to try to claim back bank charges from the Alliance and Leicester but I have come across a tick box saying Does or will your claim include any issues under the Human Rights Act 1998? Yes or No. What do I tick.

    Hiya Napz,

    Good luck for the 19th , are you all set , court bundle submitted etc.?
    T&C's submitted with court bundle for period in dispute.
    Any witness evidence gathered etc.?

    I've been told that my case has been passed for directions to the District Judge handling my case , so hopefully I'll get a date in the next 2 weeks , I'm sick of waiting , unless A&L pay up 90% of what they owe me , it's off to court.

    Any help or advice you need plz just ask.

    PS: has anyone had further correspondence from wragge's over past few days , with an improved offer?

    not sure if this is in right part of forum....
    good old A&L - on 30th May the first of three cheques bounced at £34 each = £107 , so on the 5ht June they were represented again at £34 each = £107 , so £214 in one week ,..... one of the cheques was to TSB for a debt repayment plan , so we got charged twice! , but on the 4th June TSB sent us the actual cheque back , so how is it possible for the cheque to be represented a 2nd time a day later? is that legal, A&L charging us on the 5th for something TSB sent us back on the 4th?
    and another one was for a garage bill £68.27, so we phoned the garage up and said we would pay the bill off in cash and explained that we had been charged , they said they would also have to add what thier bank had charged them to the bill , which is going to be £4 , which PROVES it does not cost the bank £34 so i have requested a copy of the garage bill which will have the £4 charge on it , so I was wondering if Martin would like a copy as proof for the bank charges campaign that it does not cost banks £34?

    I'm sick of waiting myself, My case would be over with now had that damn district judge not relisted, I suppose its not long until the 29th June, but If I get another letter around the 21st June saying my case has been relisted again I will be reporting the damn judge to someone or other

    Hi, you will find some template letters in the library, you can send them the one which states you accept the offer as 'part payment' without prejudice and you will be persuing the claim for the rest of the monies owed to you,

    Hiya

    I have filed my claim, in person, at Leicester County Court. I have been sent the defence papers stating all the rubbish it seems is in everyone elses.

    I have been sent an AQ, which I have completed using the CAG website and here for guidance, However, I've read here several times that courts aren't using the AQ's anymore. Does anyone know if this means that my case is heading down the pan?? :confused:

    I have had one offer of a quarter of the amount I'm claiming from A&L but no offers from Wragge at all. I'm just starting to get an uneasy feeling about it.

    If anyone can help me, please let me know. I'm starting to feel like its going to fall in around my ears.

    I refer to default charges applied to my account amounting to [INSERT TOTAL OF CHARGES PLUS INTEREST], which I have requested you pay back.
    I wrote to you on [INSERT DATE], making the original request for a payment in settlement of my claim. I will accept the gesture of goodwill from you that you have offered me for (INSERT OFFER) in ‘part payment’ to my claim without prejudice and I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.
    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.
