  • Help what letter do I send back to Wragg & Co. as in their defence they are saying that I failed to particularise the claim adequately.

    I have been helping a work friend reclaim. The amount of her claim is about £700. She has been offered £264 which represents the difference between the £35 bounced item charges and £12. She was going to accept this until we realised that A&L had ignored all the £25 unauthorised OD charges. Is there a suggested OK figure for this type of charge like the £12 one?

    I should add that my friend is not keen on going down the court route and for her it is important to be able to keep her existing account open.

    I received this very same letter and they too had ignored the un O/D chgs..I phoned MCOL who told me I was well within my rights to ...accept the amount as part payment WITHOUT PREJUDICE,and continue to pursue the remaining amount through the court,you have to write to them and let them know this is what you are doing. In the letter your friend received it should go on to say that they will not be closing your friends account if its the same one as mine...standard reply Im thinking. I hope this helps, I wasnt keen on doing the whole court thing but I have learned so much and it really isnt as daunting as it first seems. This place is a mine of infoand everyone is so helpful.

    Filed my MCOL claim on the 30th....it was served on the 4th...

    today i got a letter from Wragges&co stating A&L intend to defend...

    There was nothing else and no insturctions for me to do anything...

    Is this normal to recieve a letter from them so early after the claim being served and do i have to do anything??

    If you read this thread, you'll see that loads of us are claiming and are either awaiting court dates, or have been notified of them. I've had the judges directions along with court date and have just submitted these along with the supporting papers (court bundle).
    Hopefully Wragge won't get their papers in in time and I'll be applying for judgement by default. If not it will get nearer the court stage, but it's unlikely it will come to that. If it does, it's highly unlikely A&L/Wragge will turn up as they cannot defend their charges and could not afford the precedent of losing in court.
    I'm probably slightly ahead of others at this stage, so watch this space and I'll report back very soon.

    It varies as to the timing of each stage, depending on how busy the court is and how quickly A&L/Wragge decide to act. You won't get any instructions at this stage from Wragge, but should now wait for their actual defence papers. Have a good read of them when they arrive ... it's probably the "standard" defence you'll receive that all of us have (6 pages long).rolleyes.gif
    Check whether they're asking you to do/submit anything. You may have a clause within it stating that you haven't "particularised" your claim. If this is the case, send them a copy of your charges schedule, stating that you've already sent this to A&L and the court (have you?) and you trust this clarifies your claim.
    Then sit back and wait for a court date and the judges directions.

  • Thank you SandyC. That sounds very useful. Your letter was the same as my friend's and retaining her bank account is important. She also could really use the money and finding the £80 for the court fee would not be easy. Hence her inclination to accept.
    Did you accept the partial offer? Or have you gone to court for the whole lot?
