    Just calculating the charges for a friend who has an Alliance & Leicester account.

    The statement shows a lot of £25 charges for "Paid Item Charge".

    What are these and can we claim them back?

    PS Claimed £2700 from Nationwide which they agreed to and sent me 3 cheques made payable to the wrong name - naturally a stroopy letter has been sent!.

    Ive included them in my claim....they are charges for paying an item when you dont have appropriate funds....it cant possibly cost them £25 to pay something when they do it every second of every minute of every day! They'd be bankrupt :)

    Sorry I've been a bit quiet of late, I've been desperately trying to talk some reason into the Bank via Wragge & Co.

    Ready for this????

    RANT MODE ON!!! :mad:

    Basic Run Down
    ============
    I'm claiming £1700 and they offer me £264!!!
    Then they offer £364!!! :rolleyes:

    Negotiation starts......:confused:

    £1700 Reduced to £1500 (Get Stuffed No Chance) From A&L
    £1500 Reduced to £1300 .............Again Get Stuffed.......
    £1300 Down to £999.99 (Not interested)

    One off offer of settling in the middle at £850 , no response , indicating they are not interested.

    Now call me mental (But I think I tried bloody hard to meet these guys half way) , although my final offer of £850 has not yet been officially rejected , i think it's only a matter of time.

    ANYWAY.................

    It's my turn to be "Not Interested" my family have bailed me out of my financial hole i was in , and i no longer feel the need to haggle with the bank.

    I'm filing my AQ and going for it £1800 or I'll see 'em in court. (£100 AQ FEE)

    I am currently organising , "Experts" in the financial field and hopefully an EX A&L employee to give evidence. If the A&L truly want a day in court well I hope they are willing to face a belligerent git who just wont back down and who'll drag as many "Experts" and "Advisor's" into court as possible.:mad:

    I'm not afraid to lose , it's the giving up that bothers me! :D

    Who knows might even approach the FSO and see if any of the guys there fancy a day trip out to court :rotfl:

    I'll consider a decent offer but the insulting amount the A&L offered last time didn't even cover my time and effort let alone my court costs.

    All this stuff about the Hull Judge dismissing cases is unimportant in my opinion , unless a high court judge rules it , it's not a precedent setting case , and is open to appeal.

    Don't give up guys , what have we really got to lose , they have OUR money , we want it back , sounds fair to me.

    The thing that really gets my goat , is the fact that the bank are arrogant to the point where they don't even respond to fair and reasonable efforts to settle out of court.

    Even if we lose , take it as far as we can guys , at least it'll cost £100,000's in solicitors fees!

    I'm not saying don't try and negotiate with Wragge & Co/A&L , just that you'll get (A) A headache (B) RSA from all the typing (C) Nowhere fast! :rotfl:

    But aside from all that i must say Mr.Sargent is a very friendly chap to talk to , seems way too nice to be a solicitor!

    Anyway i'm picking up my ball and going home , i'll see 'em in court.

    Oh did any one else's AQ from Wragge's state "Officer of the Bank" as a witness for the defence? hehehehe :rotfl: , Officer of the bank indeed , it's hard enough to get them on the phone , let alone see them in person.

    Take care guys, stay strong , what the hell if it al goes tit's up lets all meet up for a big beer session anyway :)

    I'm well up for a full on fight with the A&L , PM and we can compare game plans and try out tactics.

    I don't give a monkeys if i lose , now they have just pee'd me off i want a fight! lol

    Hi,
    I have just received my letter from my county court giving me a hearing date of the 18th july 07. I am now at a loss of what to do next !! In your post you refer to legal doc on the CAG site can you please let me know where the docs are because i can't seem to find them !! Is it worth getting the legal stuff sent off to the courts and A & L ASAP or leaving it to nearer the 14 day limit ? I phoned my court and asked about the questionaire that everyone is going on about and they said there is no need for them anymore in bank charges cases !! Is this true ??

    Don't panic! The court bundle link is within the link below and you'll also find lots of useful info. here about what may happen :-

    You don't submit your bundle 'til you get an Order of Directions from your local court with a hearing date. At that time, you'll be asked for any number of documents and have to print off the court bundle papers as back-up. Templates for Statements of Evidence/Witness Statements, etc. if you're asked to produce these are all on the CAG site if you look through, but you have to tailor them to your requirements. Don't worry, it's not difficult. Also, if you join the CAG site, you'll get some great info. and lots of answers to any queries.

    AQ's are not usually required any more but, if your claim is over £1500, you still need to pay £100 within 14 days of notification.

  • I received my my copy of A&Ls defence from Wragge&Co this morning(along with the insufficient particulars of claim some of you have mentioned), should I be doing anything now or should I wait for something from the court?

    I was hoping they'd forgotten because they only have until the 10th of this month to file but it looks like I'll be going to court too

    It's very unlikely you'll be going to court ... if you do, A&L won't turn up; they cannot afford to lose (which they wouldrolleyes.gif) and there's no way they'll fork out to have solicitors flying all round the country to defend all these cases.

    Send a copy of your charges schedule to Wragge and mention you've already sent these to A&L and you trust this now clarifies you claim, then sit back and wait for a court date and directions from your local judge. Start to get all your correspondence/statements in order, so you can add the "court bundle" legal papers to them later (found on the CAG site).
