How can they submit a defence containing the phrase 'without prejudice' if anything containing that phrase cannot be presented in court and only referred to?
It depends on the context it is used in. In this instance they are using it as a replacement for "we're not liable, but we're just talking hypothetically".
For a letter to be considered as as being without prejudice, it has to have a big block letter "WITHOUT PREJUDICE" at the top of the letter.Hamsters have no tact and diplomacy, nor do they want any.0 -
So should I now be asking for a copy of their defence as submitted to the court? Or should I just play it along and see if they have actually included that phrase in their defence and if it differs to the copy I was sent, it would surely show their incompetence?
The court should have sent you a copy. It's not obligatory (but it is considered to be courteous) for the other side to send you a copy of their defence.Hamsters have no tact and diplomacy, nor do they want any.0 -

I'd love to know what they say to you.:rolleyes: I've read of people having success with this when 'phoning other banks, but A&L are particularly nasty and stubborn. Please let us know what happens and you never know your luck as it's a comparatively small amount and they do pay out fairly quickly for amounts under £500.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -

There were 2 due around this time in Northern Ireland, but they've been delayed 'until next month I believe ... these are probably the ones you're thinking of. I'm sure we'd have heard if anyone has already been to/approached going to court.
